OPT-DOWN FROM AN ELIGIBLE COUNTERPARTY. 28.6. A client who is considered an Eligible Counterparty has the right to opt-down; this means that the client can request a higher level of protection, namely protection that is offered to a Professional client or Retail client; unless an Eligible Counterparty expressly and specifically requests treatment as a Retail client, the client’s request will be considered as a request to be treated as a Professional Client; an Eligible Counterparty has the right to a general opt-down, covering all business conducted with us or on a “product category basis”, provided, however, that we are not obliged to accept such a categorization.
