Common use of Order Granting Preliminary Approval Clause in Contracts

Order Granting Preliminary Approval. “Order Granting Preliminary Approval” shall mean the Order entered by the Court preliminarily approving the terms set forth in this Agreement, including the manner and timing of providing notice to the Classes, the time period for objections and the date, time and location for a Fairness Hearing.

Order Granting Preliminary Approval. “Order Granting Preliminary Approval” shall mean the Order entered by the Court preliminarily approving in the form attached as Exhibit A, as modified by the Court, which, inter alia, provides preliminary approval, for settlement purposes only, of the terms set forth in and conditions of this Agreement, including Agreementand scheduling of the manner and timing of providing notice to the Classes, the time period for objections and the date, time and location for a Fairness Hearing.

Order Granting Preliminary Approval. “Order Granting Preliminary Approval” shall mean the Order entered by the Court preliminarily approving approving, inter alia, the terms set forth in and conditions of this Agreement, including the content of the parties’ proposed Class Notice (attached hereto as Exhibit A), the manner and timing of providing notice to the ClassesClass Notice, and the time period for objections opt-outs and the date, time and location for a Fairness Hearingobjections.

Order Granting Preliminary Approval. “Order Granting Preliminary Approval” shall mean the Order entered by the Court preliminarily approving approving, inter alia, the terms set forth in and conditions of the Settlement and this Agreement, including the manner and timing of providing notice to the ClassesSettlement Class Members, and the time period for objections opt-outs and objections. A proposed version of the date, time and location for a Fairness HearingOrder Granting Preliminary Approval shall be submitted to the Court in the form attached hereto as Exhibit 3.

Order Granting Preliminary Approval. “Order Granting Preliminary Approval” shall mean and refer to the Order order entered by the Court preliminarily conditionally approving the terms set forth in and conditions of this Agreement, including among other things, the conditional certification of the proposed classes, the manner and timing of providing notice to the ClassesNotice, the time period for objections opting out and filing objections, and the date, time and location for a date of the Final Fairness Hearing. The Parties will submit to the Court a proposed Order Granting Preliminary Approval in the form attached hereto as Exhibit 1.
