Other Functionality. Licensee shall be solely responsible for: (a) entering into its own arrangements with third parties, including carriers, for software functionality not provided by Pitney Bowes as part of the Pitney Xxxxx Software; and (b) payment of all fees for third-party software not expressly included in the License fee paid under the Sales/Lease Agreement, including, without limitation, fees associated with Licensee's operating environment.

Other Functionality. Customer agrees and understands that, unless provided explicitly in this Agreement, or unless otherwise agreed between the Parties, Gemini will not support any Other Functionality associated with any Digital Assets.
Other Functionality. 10.1 Without limitation to the functionality specified in the Technical Specifications or otherwise notified to the Broadcaster from time to time as being available in respect of its Channel(s), the EPG shall include functionality which (without limitation) shall enable viewers to: (i) restrict the viewing of certain programmes and certain channels via parental control functionality; (ii) select Channels to be available from a “favourites” menu; (iii) view a grid of certain categories of programmes listed alphabetically by title; (iv) view available subtitles broadcast with the Channel(s); (v) set reminders in respect of programmes broadcast in the future; and (vi) subject to the viewer having the necessary Set Top Box and Sky+ entitlement, use personal video recorder functionality in connection with the Channel(s). 10.2 The Broadcaster shall be entitled to use functionality enabling viewers to set reminders for and/or purchase programmes by reacting to the broadcast of a green icon with a relevant programme promotion (“Bookable and Purchasable Promotions functionality”) if (and only if) the Broadcaster has entered into a relevant amendment to this Agreement in accordance with Clause 15.
Other Functionality. It is acknowledged and understood that the Co-Branded Card will include the ability to perform other electronic functions in addition to or separate from the Co-Branded Card Services. WSU and Credit Union shall each be responsible for ensuring that their respective functions on the Co-Branded Card will not interfere with the functions of the other party, and the specifications defined in this Agreement, which shall be jointly verified by Credit Union and WSU through testing of the Co-Branded Card to ensure the Co- Branded Card functions properly.
Other Functionality. This product includes and may include in the future: search and apply for Below Market Rate ownership and rental housing, view started and submitted housing applications, check lottery status, down payment assistance requests and Lender selection, view started and submitted down payment assistance applications, Certificate of Preference search request, Displaced Tenant Housing Preference application, Neighborhood Housing Preference confirmation, view preference certificate status, homeownership post-purchase programs (i.e., refinance, sell home, loan payoff, etc.), update household contact information, change password and other account administration. Include authenticated sign-on for users who wish to return to their saved personal data and past applications. Meet HIPAA requirements. All data, including login information, transmitted and inside databases must be secure. Include automatic timeout (auto-logout) that can be controlled by a System Administrator. Include data architecture that guarantees redundancy and high data availability. Provide ability for MOHCD to download all data in an open non-proprietary format (i.e. XLS, SQL backup, CSV, etc.). Data must be usable by MOHCD without dependency on Contractor or other outside proprietary tools or services. For any custom developed databases, a data definition table must be included, specifying the name, size and type/class of each field, as well as any specific relationship to other fields. No invoices for Services provided by law firms or attorneys, including, without limitation, as subcontractors of Contractor, will be paid unless the provider received advance written approval from the City Attorney. Other Functionality. It is understood that ID Card may include the ability to perform other electronic functions in addition to Banking Services. University will be responsible for ensuring that any such functions will not interfere with Banking Services functions and the specifications defined in this Agreement. The functionality of the Banking Services will be verified by Bank through testing of ID Card to ensure ID Card functions properly.

  • Future Functionality You agree that Your purchases are not contingent on the delivery of any future functionality or features, or dependent on any oral or written public comments made by Us regarding future functionality or features.

  • Functionality Customer is entitled to additional functionality previously purchased or bundled with the software if available in the version or update released on or after the start date of the Agreement. Customer acknowledges that certain functionality in current and previous software versions may not be available in future upgrades. Added functionality may require additional paid services (clinical and technical) to configure and support.

  • MIXED FUNCTIONS An employee engaged for more than two hours during one day or shift on duties carrying a higher rate than his or her ordinary classification shall be paid the higher rate for such day or shift. If for two hours or less during one day or shift he or she shall be paid the higher rate for the time so worked.

  • MANAGEMENT FUNCTIONS B.1 The Association recognizes that the management of the Hospital and the direction of working forces are fixed exclusively in the Hospital and shall remain solely with the Hospital except as specifically limited by the provisions of this Agreement and, without restricting the generality of the foregoing, the Association acknowledges that it is the exclusive function of the Hospital to: (a) maintain order, discipline and efficiency; (b) hire, assign, retire, discharge, direct, promote, demote, classify, transfer, lay- off, recall, and suspend or otherwise discipline nurses, provided that a claim of discharge or discipline without just cause may be the subject of a grievance and dealt with as hereinafter provided; (c) determine, in the interest of efficient operation and high standards of service, job rating and classification, the hours of work, work assignments, methods of doing the work, and the working establishment for the service; (d) generally to manage the operation that the Hospital is engaged in and, without restricting the generality of the foregoing, to determine the number of personnel required, methods, procedures, and equipment in connection therewith; (e) make, enforce, and alter from time to time reasonable rules and regulations to be observed by the nurses which are not inconsistent with the provisions of this Agreement. B.2 These rights shall not be exercised in a manner inconsistent with the provisions of this Agreement.

  • CUSTOMER SERVICE FUNCTIONS The Servicer shall handle all Customer inquiries and other Customer service matters according to the same procedures it uses to service Customers with respect to its own charges.

  • Interoperability To the extent required by applicable law, Cisco shall provide You with the interface information needed to achieve interoperability between the Software and another independently created program. Cisco will provide this interface information at Your written request after you pay Cisco’s licensing fees (if any). You will keep this information in strict confidence and strictly follow any applicable terms and conditions upon which Cisco makes such information available.

  • Proposed Policies and Procedures Regarding New Online Content and Functionality By October 31, 2017, the School will submit to OCR for its review and approval proposed policies and procedures (“the Plan for New Content”) to ensure that all new, newly-added, or modified online content and functionality will be accessible to people with disabilities as measured by conformance to the Benchmarks for Measuring Accessibility set forth above, except where doing so would impose a fundamental alteration or undue burden. a) When fundamental alteration or undue burden defenses apply, the Plan for New Content will require the School to provide equally effective alternative access. The Plan for New Content will require the School, in providing equally effective alternate access, to take any actions that do not result in a fundamental alteration or undue financial and administrative burdens, but nevertheless ensure that, to the maximum extent possible, individuals with disabilities receive the same benefits or services as their nondisabled peers.
