Common use of OTHER RIGHTS, ETC Clause in Contracts

OTHER RIGHTS, ETC. (a) The failure of Lender to insist upon strict performance of any term hereof shall not be deemed to be a waiver of any term of this Security Instrument. Mortgagor shall not be relieved of Mortgagor’s obligations hereunder by reason of (i) the failure of Lender to comply with any request of any Guarantor to take any action to foreclose this Security Instrument or otherwise enforce any of the provisions hereof or of the Note or the other Secured Note Documents, (ii) the release, regardless of consideration, of the whole or any part of the Property, or of any Person liable for the Debt or any other Obligations or any portion thereof, or (iii) any agreement or stipulation by Lender extending the time of payment or otherwise modifying or supplementing the terms of the Note, the Credit Agreement, the Guaranty, this Security Instrument or the other Secured Note Documents.

Mortgagor Borrower shall not be relieved of MortgagorBorrower’s obligations hereunder by reason of (i) the failure of Lender Lender, Beneficiary or Trustee to comply with any request of Borrower or any Guarantor guarantor or indemnitor with respect to the Loan to take any action to foreclose this Security Instrument or otherwise enforce any of the provisions hereof or of the Note or the other Secured Note Loan Documents, (ii) the release, regardless of consideration, of the whole or any part of the Property, or of any Person person liable for the Debt or any other Obligations or any portion thereof, or (iii) any agreement or stipulation by Lender extending the time of payment or otherwise modifying or supplementing the terms of the Note, the Credit Agreement, the Guaranty, this Security Instrument or the other Secured Note Loan Documents.

OTHER RIGHTS, ETC. (a) The failure of Lender Beneficiary to insist upon strict performance of any term hereof shall not be deemed to be a waiver of any term of this Security Instrument. Mortgagor Grantor shall not be relieved of Mortgagor’s Grantor's obligations hereunder by reason of (i) the failure of Lender Beneficiary to comply with any request of Grantor, any Guarantor or any Indemnitor to take any action to foreclose this Security Instrument or otherwise enforce any of the provisions hereof or of the Note Guaranty or the other Secured Note Other Security Documents, (ii) the release, regardless of consideration, of the whole or any part of the Property, or of any Person person liable for the Debt or any other Obligations or any portion thereof, or (iii) any agreement or stipulation by Lender Beneficiary extending the time of payment or otherwise modifying or supplementing the terms of the Note, the Credit Agreement, the Guaranty, this Security Instrument or the other Secured Note Other Security Documents.
