OVERLOADING AND UNDER LOADING. 12.4.1 The Purchaser shall be responsible to take delivery of the Contracted Grade of Coal at the Delivery Point and ensure that there is no overloading. Any penal freight for overloading charged by the railways for any consignment shall be payable by the Purchaser. However, if overloading is detected from the Delivery Point consistently during 3 (three) continuous months, the Purchaser shall duly inform the Seller of the same. 12.4.2 For non-coking coal of GCV exceeding 5800 KCal/ Kg and coking coal of steel grade I, steel grade II, washery grade I, washery grade II, semi-coking grade I, semi-coking grade II and washed coal; any idle freight on account of loading below the following namely, the: (i) stenciled carrying capacity as shown on the wagon; or (ii) carrying capacity based on the actual tare weight, where the empty wagon has been weighed; or (iii) permissible carrying capacity as notified by the railways (route-wise) for any particular type of wagon from time to time, in case stenciled carrying capacity as shown on the wagon is more than the permissible carrying capacity, as the case may be, shall be borne by the Seller. For all other Grades of Coal, any idle freight on account of under-loading below: (i) the stenciled carrying capacity, as shown on the wagon; or (ii) carrying capacity based on the actual tare weight, as the case maybe, plus 2 (two) tonnes shall be borne by the Seller. 11.3 Idle freight resulting from under-loading of wagon, as the case maybeper Clause 11.2, and the freight payable as per actual recorded weight of coal loaded shall be adjusted in the wagon; and/or
(b) for all other Grades of Coal, bills. Idle freight shall be reckoned as the difference between the freight charges applicable charged by the railways/freight payable for the stenciled carrying capacity/freight payable for stenciled carrying capacity plus two (2) tonnes, as shown on the wagon or carrying capacity based on actual tare weight, as the case may be, plus 2 (two) tonnes less applicable in terms of Clause 11.2 and the freight payable as per for the actual recorded weight of the Contracted Grade of Coal loaded in the wagonwagons. HoweverIt is clarified that the compensation shall comprise basic railway freight and other applicable charges such as DPC, in DS etc. actually levied by the cases where permissible carrying capacity is less than railway under the stenciled carrying capacity, as mentioned above, the difference shall be reckoned between the freight applicable for the permissible carrying capacity and the freight payable as per the actual recorded weight of the Contracted Grade of Coal loaded in the wagonrespective consignment.

11.3 Idle freight resulting from under-loading of wagon, as the case maybeper Clause 11.2, and the freight payable as per actual recorded weight of coal loaded shall be adjusted in the wagon; and/or
(b) for all other Grades of Coal, bills. Idle freight shall be reckoned as the difference between the freight charges applicable charged by the railways/freight payable for the stenciled carrying capacity/freight payable for stenciled carrying capacity plus two (2) tonnes, as shown on the wagon or carrying capacity based on actual tare weight, as the case may be, plus 2 (two) tonnes less applicable in terms of Clause 11.2 and the freight payable as per for the actual recorded weight of the Contracted Grade of Coal loaded in the wagonwagons. (ii) wagon or carrying capacity based on the actual tare weight, where the empty wagon has been weighed; or
(iii) weightor permissible carrying capacity as notified by the railways Railways (route-wise) for any particular type of wagon from time to time, in which case the stenciled carrying capacity as shown on the wagon is more than the permissible carrying capacity,, as the case may be, shall be borne by the Seller. For all other Grades of Coal, any idle freight on account of for under-loading below:
(i) below the stenciled carrying capacity, as shown on the wagon; or
(ii) wagon or carrying capacity based on the actual tare weight, as the case maybemay be, plus 2 two (two2) tonnes shall be borne by the Seller. However, in the cases where permissible carrying capacity is less than the stenciled carrying capacity, as mentioned above, the idle freight shall be borne by the Seller only up to the permissible carrying capacity.
12.4.3 10.3 Idle freight resulting from under loading of wagon, as per Clause 12.4.210.2, shall be adjusted in the bills. Idle freight shall be reckoned as:
(a) for non-coking coal of GCV exceeding 5800 KCal/ Kg and coking coal of steel grade I, steel grade II, washery grade I, washery grade II, semi-coking grade I, semi-coking grade II and washed coal, the difference between the freight charges applicable for the stenciled carrying capacity, as shown on the wagon or carrying capacity based on actual tare weight or permissible carrying capacity as notified by the railways (route-wise) for any particular type of wagon from time to time, in which case the stenciled carrying capacity as shown on the wagon is more than the permissible carrying capacity, as the case maybe, and the freight payable as per actual recorded weight of coal loaded in the wagon; and/or
(b) for all other Grades of Coal, the difference between the freight charges applicable for the stenciled carrying capacity, as shown on the wagon or carrying capacity based on actual tare weight, as the case may be, plus 2 (two) tonnes less the freight payable as per actual recorded weight of the Contracted Grade of Coal loaded in the wagon. However, in the cases where permissible carrying capacity is less than the stenciled carrying capacity, as mentioned above, the difference shall be reckoned between the freight applicable for the permissible carrying capacity and the freight payable as per the actual recorded weight of the Contracted Grade of Coal loaded in the wagon.

OVERLOADING AND UNDER LOADING. 12.4.1 The Purchaser shall be responsible to take delivery of the Contracted Grade of Coal at the Delivery Point and ensure that there is no overloading. 11.1 Any penal freight for overloading charged by the railways for any consignment shall be payable by the Purchaser. However, if overloading is detected from the Delivery Point any particular colliery, consistently during 3 three (three3) continuous monthsMonths, on due intimation from the Purchaser to this effect, the Purchaser shall duly inform the Seller of the sameundertakes to take remedial measures.
12.4.2 11.2 For non-coking coal of GCV exceeding 5800 KCal/ Kcal/Kg and coking coal of steel grade Steel Grade I, steel grade Steel Grade II, washery grade Washery Grade I, washery grade Washery Grade II, semiSemi-coking grade Grade I, semiSemi-coking grade Grade II and washed coalCoal; any idle freight on account of for under-loading below the following namely, the:
(i) stenciled carrying capacity capacity, as shown on the wagon; or
(ii) carrying capacity based on wagon or minimum chargeable weight for the actual tare weight, where the empty wagon has been weighed; or
(iii) permissible carrying capacity purpose of freight charges as notified by the railways (route-wise) for any particular type of wagon from time to time, in case stenciled carrying capacity as shown on the wagon whichever is more than the permissible carrying capacity, as the case may belesser, shall be borne by the Seller. For all other Grades of Coal, any idle freight on account of for under-loading below:
(i) below the stenciled carrying capacity, as shown on plus two (2) tonnes, or minimum chargeable weight for the wagon; or
(ii) carrying capacity based on the actual tare weight, as the case maybe, plus 2 (two) tonnes shall be borne by the Seller. However, in the cases where permissible carrying capacity is less than the stenciled carrying capacity, as mentioned above, the idle freight shall be borne by the Seller only up to permissible carrying capacity.
12.4.3 Idle freight resulting from under loading purpose of wagon, as per Clause 12.4.2, shall be adjusted in the bills. Idle freight shall be reckoned as:
(a) for non-coking coal of GCV exceeding 5800 KCal/ Kg and coking coal of steel grade I, steel grade II, washery grade I, washery grade II, semi-coking grade I, semi-coking grade II and washed coal, the difference between the freight charges applicable for the stenciled carrying capacity, as shown on the wagon or carrying capacity based on actual tare weight or permissible carrying capacity as notified by the railways (route-wise) for any particular type of wagon from time to time, in which case whichever is lesser, shall be borne by the stenciled carrying capacity as shown on the wagon is more than the permissible carrying capacitySeller.
11.3 Idle freight resulting from under-loading of wagon, as the case maybeper Clause 11.2, and the freight payable as per actual recorded weight of coal loaded shall be adjusted in the wagon; and/or
(b) for all other Grades of Coal, bills. Idle freight shall be reckoned as the difference between the freight charges applicable charged by the railways/freight payable for the stenciled carrying capacity/freight payable for stenciled carrying capacity plus two (2) tonnes, as shown on the wagon or carrying capacity based on actual tare weight, as the case may be, plus 2 (two) tonnes less applicable in terms of Clause 11.2 and the freight payable as per for the actual recorded weight of the Contracted Grade of Coal loaded in the wagonwagons. HoweverIt is clarified that the compensation shall comprise basic railway freight and other applicable charges such as DPC, in DS etc. actually levied by the cases where permissible carrying capacity is less than railway under the stenciled carrying capacity, as mentioned above, the difference shall be reckoned between the freight applicable for the permissible carrying capacity and the freight payable as per the actual recorded weight of the Contracted Grade of Coal loaded in the wagonrespective consignment.
