Owner Equipment Clause Samples

The 'Owner Equipment' clause defines the rights and responsibilities regarding equipment provided by the owner for use in a project or contract. Typically, this clause specifies which items the owner will supply, the condition in which they must be provided, and the obligations of the contractor or other parties to maintain, use, or return the equipment. For example, it may require the contractor to inspect the equipment upon receipt and report any defects, or to ensure the equipment is only used for authorized purposes. The core function of this clause is to clearly allocate responsibility for owner-supplied equipment, reducing disputes over damage, loss, or misuse during the course of the project.
Owner Equipment. Owner shall procure and provide Owner Equipment by the dates set forth in the Schedule in order to prevent delay. Except to the extent that Contractor’s failure to perform its obligations in accordance with this Agreement hereof is the cause of such non-performance or schedule delay, any impact to Contractor from the delay (or re-sequence) in delivery or performance of Owner Equipment shall give rise to a Change.
Owner Equipment. Owner's obligations with respect to the Owner Equipment and Prior Work are specified in Section 4.4. Except as provided in Section 3.19, Section 6.1 and Section 11.1, Contractor shall bear all other risks with respect to the Owner Equipment and Prior Work, including delay, schedule and performance risks. Contractor shall expedite material and equipment deliveries for Owner Equipment and promptly advise Owner of any outstanding critical material or equipment associated with Owner Equipment.
Owner Equipment. Contractor shall not use any Owner Equipment in any way or for any purpose unless use of such equipment is specifically included in the contract.
