Customer shall have the right on up to two (2) occasions during the Term to, at Customer’s sole cost and expense, replace some or all of the Customer Equipment at the Facility with newer generation equipment.
Service Provider will, arrange for the deinstallation of old Customer Equipment and installation of the new Mining Equipment in a manner that to the extent practicable minimizes the interruption to mining activities (e.g., “hot swapping” equipment in real time).
Service Provider has no obligation to replace, repair, or fix any issues or defects in the Mining Equipment or the Customer Environment related to consumption of power (i.e., inefficient performance of a particular piece of Customer Equipment) (“Energy Consumption”).
It is understood that Service Provider is not an insurer and Customer’s Customer Equipment is not covered by any insurance policy held by Service Provider.
Service Provider shall bear the reasonable costs of unracking and packing the Customer Equipment ready for shipment.
