Ownership of Material BOTH. ‌ It is understood that the Creative Compensation fees above shall serve as payment for a license for the Theatre’s exclusive use of the material in perpetuity for their own Productions and Revues. The Theatre agrees that all material developed during rehearsals or performances under this Agreement shall remain the property of the Artist. Should the Theatre ever lease the material for use by an outside entity, the Artists on contract at the time of the development of the material shall receive a pro rata share of fifty percent (50%) of the proceeds from such lease. When an Artist wishes to use a solo scene, character or monologue that they created for public use, they shall notify the Theatre in writing at least one (1) week before such a use. 41:00 OVERNIGHT REST PERIOD ‌ 41:01 Standard BOTH‌ For all Artists other than Stage Management, there shall be a minimum of twelve (12) hours between the end of one day’s work and the first call on the next day. During the overnight rest period the Artist shall not be required to provide any service to Theatre without an additional payment as provided below: 2019-2021 Per Half Hour $26.50

This Agreement creates a nonexclusive and perpetual license for WESTERN to copy, use, modify, reuse, or sublicense any and all copyrights, designs, and other intellectual property embodied in plans, specifications, studies, drawings, estimates, and other documents or works of authorship fixed in any tangible medium of expression, including but not limited to, physical drawings or data magnetically or otherwise recorded on computer diskettes, which are prepared or caused to be prepared by CONSULTANT under this Agreement (“Documents & Data”). CONSULTANT shall require all subcontractors to agree in writing that WESTERN is granted a nonexclusive and perpetual license for any Documents & Data the subcontractor prepares under this Agreement. CONSULTANT represents and warrants that CONSULTANT has the legal right to license any and all Documents & Data. CONSULTANT makes no such representation and warranty in regard to Documents & Data which were prepared by design professionals other than CONSULTANT or provided to CONSULTANT by WESTERN. WESTERN shall not be limited in any way in its use of the Documents and Data at any time, provided that any such use not within the purposes intended by this Agreement shall be at WESTERN's sole risk.

  • Ownership of Content 4.1 All materials including paper based resources, and all materials displayed on the Site and the Apps, including without limitation all information, text, materials, graphics, software, tools, results derived from the use of software and tools, advertisements, names, logos and trade marks on the paper based version, the Site and the Apps (Content) are protected by copyright, trade mark and other intellectual property laws unless otherwise indicated.

  • Ownership of Results Any interest of Contractor or its subcontractors, in the Deliverables, including any drawings, plans, specifications, blueprints, studies, reports, memoranda, computation sheets, computer files and media or other documents prepared by Contractor or its subcontractors for the purposes of this Agreement, shall become the property of and will be transmitted to City. It is the responsibility of each Party to ensure at no additional cost to the other Party that it has obtained any necessary licenses in relation to intellectual property of third Parties used in its network that may be required to enable the other Party to use any facilities or equipment (including software), to receive any service, or to perform its respective obligations under this Agreement.

  • OWNERSHIP OF PRODUCTS It is understood and agreed that all products provided under this Agreement shall become the property of the County upon acceptance by the County.
