Ownership of Subscriber Data. As between Acumatica and you, you own your Subscriber Data.
Ownership of Subscriber Data. As between Mark43 and Subscriber, Subscriber owns the Subscriber Data. Subscriber hereby grants to Mark43, a royalty-free, worldwide, non-transferable (except as permitted by Section 11.2), non-sublicensable (except to Mark43’s contractors on a need- to-know basis to assist Mark43 in providing the Services), license to use the Subscriber Data to configure and provide the Services to Subscriber, to prevent or address service or technical problems, in accordance with this Agreement and the Documentation, and otherwise in accordance with Subscriber’s requests or instructions. Mark43 may also use Subscriber Data in anonymized and aggregated form to develop analytics and improvements that may be used in connection with the products and services of Mark43, provided that Mark43 may not sell or offer for sale any Subscriber Data on a standalone basis, whether in Subscriber identifiable, or anonymized and aggregated form.
Ownership of Subscriber Data. As between the parties, Subscriber will be the sole and exclusive owner of all databases, information, data and metadata, including without limitation information identifying or otherwise relating to Subscriber's clients, provided to EZOPS by Subscriber, uploaded by Subscriber into the EZOPS SaaS environment or otherwise acquired or used by EZOPS or accessed by EZOPS from hardware, software, databases or Subscriber Access Systems owned or leased by, or proprietary to, Subscriber or licensed to Subscriber by third parties (collectively, the “Subcriber Data”). EZOPS shall utilize the Subscriber Data solely for purposes of this Agreement and shall not sell, transfer, lease, or otherwise commercially exploit the Subscriber Data. Subscriber Data will be deemed Subscriber Confidential Information for purposes of Section 8. EZOPS is not responsible for the accuracy, completeness, or currency of Subscriber Data. Subscriber represents and warrants that it has the appropriate rights to provide Subscriber Data to EZOPS in accordance with the terms of this Agreement.

Subscriber acknowledges that when using Next DLP Products, Next DLP may access, use, transmit, modify and copy Subscriber Data from time to time as necessary solely for the purpose of providing Next DLP Products, Support Services and Next DLP Services to Subscriber and related support and administration or otherwise as requested by Subscriber or permitted hereunder.

Subscriber, not Sparta, has sole responsibility for the content, accuracy, quality, integrity, legality, reliability, appropriateness and Intellectual Property ownership or right to use of all Subscriber Data, and Sparta is not responsible or liable for Subscriber’s actions related to the deletion, correction, destruction, damage, loss or failure to store any Subscriber Data.
Ownership of Subscriber Data. As between Mark43 and Subscriber, Subscriber owns the Subscriber Data. Mark43 will have, and Subscriber hereby grants and agrees to grant to Mark43, a royalty-free, worldwide, transferable, sublicensable, irrevocable, perpetual license to use the Subscriber Data to configure and/or provide the SaaS Services, Software, Support Services and Professional Services to Subscriber, and/or to prevent or address service or technical problems, in accordance with this Agreement and the Documentation, or otherwise in accordance with Subscriber’s requests or instructions. Mark43 may also use Subscriber Data in anonymized and/or aggregated form to develop analytics that may be used to provide products and services to Subscriber and/or to other Mark43 customers, provided that: (a) Mark43 makes available to Subscriber functionality and services based on anonymized data obtained from other Mark43 customers that are similar to the functionality and services provided to such other customers based on the anonymized data; and (b) Mark43 may not sell or offer for sale any Subscriber Data, whether in Subscriber identifiable, or anonymized and aggregated form. Mark43 shall comply with its obligations under all Applicable Laws in its provision of the Services and use of Subscriber Data.
Ownership of Subscriber Data. As between Prista and Subscriber, Subscriber exclusively own all rights, title and interest in and to all of Subscriber Data. Subscriber understands and agrees that Prista will aggregate Subscriber Data, anonymously, to provide its own value-added consolidated data values, benchmarks, other data ‘measures’ etc. that in no way identifies, or reflects in any way upon, Subscriber, or discloses Subscriber’s patients’ protected health information (PHI).
Ownership of Subscriber Data. As between the parties, Subscriber is the owner of all Subscriber Data; provided, however, that nothing herein shall prevent Chargerback from using or disclosing such Subscriber Data as may be required by law, or as otherwise permitted in this Agreement.

As between the parties, the Subscriber and its licensors shall own all right, title and interest in and to all of the Subscriber Data, Subscriber shall have sole responsibility for the legality, reliability, integrity, accuracy and quality of all such Subscriber Data and the means by which it acquired the Subscriber Data. Subscriber hereby represents and warrants that any Subscriber Data has not been collected, stored, and transferred to Sprout Social in violation of any law, regulation, or contractual obligation applicable to Subscriber.
