Common use of Partial Release of Assurances Clause in Contracts

Partial Release of Assurances. The City may issue a partial release of assurances, releasing some of the Subdivision from this Agreement if both of the following have occurred: All of the Improvements that are required for, benefit, or serve the released lots have been completed in accordance with Paragraph 6 of this Agreement; and The City determines that the released lots and the Improvements that are required for, benefit, or serve the released lots can be used and maintained separately from the Improvements that are not yet completed.
