Partial Shipment. Partial shipments will not be accepted unless authorized on the delivery order or by the OCO prior to the time of delivery order award. A partial shipment is any shipment that does not include all items specified in the order.
Partial Shipment. In the event an order is shipped incomplete (partial), the Procuring Eligible Organization must pay for each shipment as invoiced by Supplier unless the Procuring Eligible Organization has clearly specified “No Partial Shipment” on each purchase order.
Partial Shipment. In the event SELLER anticipates delivery of a quantity less than that required in a Purchase Order, SELLER shall promptly notify BUYER of such event whereupon BUYER may, in its sole discretion, (i) reject the partial delivery; or (ii) accept the partial delivery; provided, however, that in any case SELLER shall bear all extra costs resulting from such partial shipment and shall be liable towards BUYER for all costs and damages without prejudice to any other rights accruing under this Agreement or in law. For the avoidance of doubt, in the event BUYER rejects a partial delivery, BUYER shall arrange for the return of the partial delivery to SELLER at SELLER’s cost and expense in a transport manner comparable to the delivery transport manner; provided, that in such event, BUYER shall have no liability for any damage or loss incurred in connection with the return of the partial delivery.
Partial Shipment. Partial shipment of Goods to be delivered pursuant to an Order will not be made without Xxxxx's knowledge and consent. In the event a complete shipment cannot be made by the delivery date indicated on the Order; Buyer will be notified and asked whether entire shipment shall be held or partial shipment made. If partial shipment, with Xxxxx's approval, is made, excess freight charges, if any, will be billed to Seller.
Partial Shipment. The Seller may, at its option, make partial shipments of Equipment and invoice the Buyer for each shipment individually in which case each delivery shall constitute a separate contract. Failure by the Seller to deliver any one or more of the shipments in accordance with these terms and conditions or any claim by the Buyer in respect of any one or more shipments shall not entitle the Buyer to terminate the whole Contract or refuse to accept subsequent shipments. The Buyer shall accept any early delivery.

Partial Shipment. Subject to written notice being given to Nuance, Altamira may make partial shipments of Purchase Orders, which shall be paid for when due, without regard to any subsequent shipments. Notwithstanding the foregoing, Nuance and Altamira shall each use commercially reasonable efforts to honour Purchase Orders received after participating in tenders as agreed by the Parties. In such circumstances, each of the Parties shall only be obligated to meet the required volumes under that commitment to last a total of six (6) months. Delay in shipment or delivery of any particular instalment shall not relieve Nuance from its obligation to accept and pay for any remaining instalments and compliance with its obligations hereunder; provided that, subject to Section 3.3, delivery of all instalments shall be made within fourteen (14) calendar days after the delivery date set forth in such Purchase Order. Altamira has the right to deliver each Product within a plus or minus [***] tolerance of the requested quantity of units of each SKU in the accepted Purchase Order, provided that prior notice thereof is given by Altamira and approved by Nuance. Such approval will not be unreasonably withheld by Nuance.
