Common use of Payment of Supplementary Xxxx Clause in Contracts

Payment of Supplementary Xxxx. 10.7.1 SPD may raise a ("Supplementary Xxxx") for payment on account of: i) Adjustments required by the Energy Accounts (if applicable); or ii) Change in Law as provided in Article 12, or and such Supplementary Xxxx shall be paid by the other Party. 10.7.2 NTPC shall remit all amounts due under a Supplementary Xxxx raised by the SPD to the SPD's Designated Account by the Due Date. For such payments by NTPC, Rebate as applicable to Monthly Bills pursuant to Article 10.3.5 shall equally apply, except in the case of payment of Late Payment Surcharges. If any claim is being raised by the Discom(s) pursuant to the Article 4.4.1, NTPC shall make adjustment in the payment made to the SPD. 10.7.3 In the event of delay in payment of a Supplementary Xxxx by either Party beyond its Due Date, a Late Payment Surcharge shall be payable at the same terms applicable to the Monthly Xxxx in Article 10.3.3.

If any claim is being raised by the Discom(s) Buying Utilities pursuant to the Article 4.4.1, NTPC SECI shall make adjustment in the payment made to the SPD. 10.7.3 In the event of delay in payment of a Supplementary Xxxx by either Party beyond its Due Date, a Late Payment Surcharge shall be payable at the same terms applicable to the Monthly Xxxx in Article 10.3.3.

Similarly, the SPD shall pay all amounts due under a Supplementary Xxxx raised by Procurers, if any, by the Due Date to concerned Procurers designated bank account. For such payments by NTPCProcurers, Rebate as applicable to Monthly Bills pursuant to Article 10.3.5 10.3.4 shall equally apply, except in the case of payment of Late Payment Surcharges. If any claim is being raised by the Discom(s) pursuant to the Article 4.4.1, NTPC shall make adjustment in the payment made to the SPD. 10.7.3 10.8.3 In the event of delay in payment of a Supplementary Xxxx by either Party beyond its Due Date, a Late Payment Surcharge shall be payable at the same terms applicable to the Monthly Xxxx in Article 10.3.310.3.4.

Payment against above supplementary xxxx will be made after realization of the case of same from the Buying Utility. No surcharge will be applicable other than that on the monthly energy payment of Late Payment Surcharges. If any claim is being raised by the Discom(s) pursuant to the Article 4.4.1, NTPC shall make adjustment in the payment made to the SPDand associated debit and credit note. 10.7.3 In the event of delay in payment of a Supplementary Xxxx by either Party beyond its Due Date, a Late Payment Surcharge shall be payable at the same terms applicable to the Monthly Xxxx in Article 10.3.3. 10.7.4 If any claim is being raised by the Buying Entity pursuant to the Article related to CUF (mentioned the article no 4.4.1), SECI shall make adjustment in the payment made to the SPD.
