Common use of Payments and Transfers Clause in Contracts

Payments and Transfers. 1. Except under the circumstances envisaged in Article 11, a Party shall not apply restrictions on international transfers and payments for current transactions relating to its specific commitments. 2. Nothing in this Agreement shall affect the rights and obligations of any Party who is a member of the International Monetary Fund under the Articles of Agreement of the Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the Fund, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments regarding such transactions, except under Article 11 or at the request of the Fund.

Payments and Transfers. 1. Except under the circumstances envisaged in Article 11, 7.17 a Party shall not apply restrictions on international transfers and payments for current transactions relating to its specific commitments. 2. Nothing in this Agreement Chapter shall affect the rights and obligations of any Party who is a member the Parties as members of the International Monetary Fund under the Articles of Agreement of the Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the FundAgreement, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments regarding such transactions, except under Article 11 7.17 or at the request of the Fund.

Nothing in this Agreement Chapter shall affect the rights and obligations of any Party who is a member andobligations of the International Monetary Parties as members of the InternationalMonetary Fund under the Articles of Agreement of the theInternational Monetary Fund, including the use of exchange actions exchangeactions which are in conformity with the Articles of Agreement of Agreementof the International Monetary Fund, provided that a Party shall not impose restrictions on any capital transactions inconsistently transactionsinconsistently with its specific commitments under this Chapter regarding such transactions, except under Article 11 69, or at the request of the International Monetary Fund.

Nothing in this Agreement Chapter shall affect the rights and obligations of any Party who is a member the Parties as members of the International Monetary Fund (hereinafter referred to in this Chapter as “the Fund”) under the Articles of Agreement of the Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the Fund, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments regarding such transactions, except under Article 11 68 below, or at the request of the Fund.

Nothing in this Agreement Chapter shall affect the rights and obligations of any Party who is a member the Parties as members of the International Monetary Fund under the Articles of Agreement of the International Monetary Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the International Monetary Fund, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments obligations under this Chapter regarding such transactions, except under Article 11 9.13, or at the on request of the International Monetary Fund.

Nothing in this Agreement Chapter shall affect the rights and obligations of any Party who is a member the Parties as members of the International Monetary Fund under the Articles of Agreement of the International Monetary Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the International Monetary Fund, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments under this Chapter regarding such transactions, except under Article 11 82, or at the request of the International Monetary Fund.

Nothing in this Agreement Chapter shall affect the rights and obligations of any Party who is a member the Parties as members of the International Monetary Fund under the Articles of Agreement of the Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the FundAgreement, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments regarding such transactions, except under Article 11 5.13 or at the request of the International Monetary Fund.

Except Subject to its reservations pursuant to Article 9.6 and except under the circumstances envisaged in Article 119.16, a Party shall not apply restrictions on international transfers and payments for current transactions relating to its specific commitmentstransactions. 2. Nothing in this Agreement Chapter shall affect the rights and obligations of any Party who is a member the Parties as members of the International Monetary Fund under the Articles of Agreement of the Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the FundAgreement, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments obligations under this Chapter regarding such transactions, except under Article 11 9.16, or at the request of the Fund.

Nothing in this Agreement shall affect the rights and obligations of any Party who is a member of the International Monetary Fund under the Articles of Agreement of the Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the FundAgreement, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments regarding such transactions, except under Article 11 12 or at the request of the Fund.

Nothing in this Agreement Chapter shall affect the rights and obligations of any Party who is a member of the International Monetary Fund Parties under the Articles of Agreement of the FundIMF Agreement, including the use of exchange actions which are in conformity with the Articles of Agreement of the Fundthat Agreement, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments regarding such transactions, except under Article 11 11.14 or at the request of the International Monetary Fund.

Except under the circumstances envisaged in Article 1181, a Party shall not apply restrictions on international transfers and payments for current transactions relating to its specific commitments. 2. Nothing in this Agreement shall affect the rights and obligations of any a Party who is a member of the International Monetary Fund under the Articles of Agreement of the Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the Fund, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments regarding such transactions, except under Article 11 81 or at the request of the Fund.

Nothing in this Agreement shall affect the rights and obligations of any Party who is a member of the International Monetary Fund under the Articles of Agreement of the Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the FundAgreement, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments regarding such transactions, except under Article 11 12 or at the request of the Fund.

Except under the circumstances envisaged in Article 11Article88, a Party shall not apply restrictions on international transfers internationaltransfers and payments for current transactions relating to its specific commitmentstotrade in services. 2. Nothing in this Agreement Chapter shall affect the rights and obligations of any Party who is a member andobligations of the International Monetary Parties as members of the InternationalMonetary Fund under the Articles of Agreement of the theInternational Monetary Fund, including the use of exchange actions exchangeactions which are in conformity with the Articles of Agreement ofAgreement of the International Monetary Fund, provided that a thata Party shall not impose restrictions on any capital transactions capitaltransactions inconsistently with its specific commitments under thisChapter regarding such transactions, except under Article 11 Article88, or at the request of the International Monetary Fund.

Nothing in this Agreement Chapter shall affect the rights and obligations of any Party who is a member the Parties as members of the International Monetary Fund (hereinafter referred to in this Chapter as "the Fund") under the Articles of Agreement of the Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the Fund, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments regarding such transactions, except under Article 11 68 below, or at the request of the Fund.

Except under the circumstances envisaged in Article 116.17 or restrictions specified in its Schedule of Specific Commitments, a Party shall not apply restrictions on international transfers and payments for current transactions relating to its specific commitments. 2. Nothing in this Agreement Chapter shall affect the rights and obligations of any Party who is a member the Parties as members of the International Monetary Fund (“IMF”) under the Articles of Agreement of the Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the FundAgreement, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments regarding such transactions, except under Article 11 6.17 or at the request of the Fund.

Except under the circumstances envisaged in Article 1111 (Restrictions to Safeguard the Balance-of-Payments), a Party shall not apply restrictions on international transfers and payments for current transactions relating to its specific commitmentstrade in services. 2. Nothing in this Agreement shall affect the rights and obligations of any Party who is a member the Parties as members of the International Monetary Fund (hereinafter referred to in this Article as “the Fund”) under the Articles of Agreement of the International Monetary Fund, as may be amended, including the use of exchange actions which are in conformity with the Articles of Agreement of the International Monetary Fund, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments under this Agreement regarding such transactions, except under Article 11 11, or at the request of the Fund.

Payments and Transfers. 1. Except under the circumstances envisaged in Article 1111 (Restrictions to Safeguard the Balance of Payments), a Party shall not apply restrictions on international transfers and payments for current transactions relating to its specific commitments. 2. Nothing in this Agreement Chapter shall affect the rights and obligations of any Party who is a member of the International Monetary Fund (the “Fund”) under the Articles of Agreement of the Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the Fund, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments regarding such transactions, except under Article 11 (Restrictions to Safeguard the Balance of Payments) or at the request of the Fund.

Except under the circumstances envisaged in Article 1168 70 below, a Party shall not apply restrictions on international transfers and payments for current transactions relating to its specific commitments. 2. Nothing in this Agreement Chapter shall affect the rights and obligations of any Party who is a member the Parties as members of the International Monetary Fund (hereinafter referred to in this Chapter as “the Fund”) under the Articles of Agreement of the Fund, including the use of exchange actions which are in conformity with the Articles of Agreement of the Fund, provided that a Party shall not impose restrictions on any capital transactions inconsistently with its specific commitments regarding such transactions, except under Article 11 68 70 below, or at the request of the Fund.
