Payments Contingent upon State/Federal Funding Sample Clauses

Payments Contingent upon State/Federal Funding. Payments under the Contract may be subject to and contingent upon continued funding by the state and/or federal government(s). In such event, no payment shall be made until the Consultant submits documentation in the manner and form as shall be required by the state and/or federal government. If late submission of claims precludes the County from claiming state or federal reimbursement, such late claims shall not be honored. If, for any reason, the full amount of such funding is not made available to the County, the Contract may be terminated in whole or in part, or the amount payable to the Consultant may be reduced at the discretion of Department, provided that any such termination or reduction shall not apply to allowable costs incurred by the Consultant prior to such termination or reduction, and provided that money has been appropriated for payment of such costs. The Consultant’s failure to submit, or failure to timely submit, such documentation shall be an Event of Default.
