Common use of Payments for Production Clause in Contracts

Payments for Production. Seller is not obligated by virtue of any take or pay payment, advance payment or other similar payment (other than royalties, overriding royalties and similar arrangements) to deliver hydrocarbons, or proceeds from the sale thereof, attributable to the Subject Interests at some future time without receiving payment therefor at or after the time of delivery, excluding, however, any imbalances attributable to the Subject Interests.

Payments for Production. Seller is not obligated by virtue of any take or a take-or-pay payment, advance payment payment, or other similar payment (other than royalties, overriding royalties and similar arrangements) to deliver hydrocarbonsHydrocarbons, or proceeds from the sale thereof, attributable to Seller’s interest in the Subject Interests Assets at some future time without receiving payment therefor at or after the time of delivery, excluding, however, any imbalances attributable to the Subject Interests.
