Consumables Sample Clauses

Consumables. During the design phase, Purchaser may participate in the selection of suppliers of consumables of the Supplier. In such case, the choice regarding the final selection of the said suppliers shall be mutually agreed between the Parties. Two suppliers shall be identified and selected for each type of consumables.

Consumables. Hardware Support does not include the delivery, return, replacement, or installation of supplies or other consumable items (including, but not limited to, operating supplies, magnetic media, print heads, ribbons, toner, and batteries) unless otherwise stated in a Transaction Document.

Consumables. During the term of this Agreement, Oxford will replace any Consumables that do not perform in accordance with Oxford’s then-current Specifications for the same; provided that, any nonconformance is not attributable to (a) abuse, misuse, neglect, negligence, accident, improper storage or use contrary to the Documentation, Specifications or this Agreement, including, without limitation, provisions regarding Useful Life; (b) improper handling including use beyond the Useful Life; (c) Force Majeure events or (d) use with a third party’s good not provided by Oxford.

Consumables. Consumables shall not be considered on a percentage of cost bases.

Consumables. Contractor’s Laboratory Service Provider shall supply, at no additional charge to Offenders, all consumables required, such as wrapped specimen bottles, caps, and urine/specimen containers, which shall be standard sized, leak- proof, and free of any contaminant or preservative that could alter the drugs or metabolites. For pick-up and shipping purposes, Contractor’s Laboratory Service Provider shall supply pre-addressed labels and forms, chain of custody forms, and mailer/transportation cartons.

Consumables. 18.1. The Contractor will be expected to manage their stock of consumables (excluding paper) to meet the requirements of any contracted Framework Public Body under the Framework. 18.2. The Contractor is required to provide consumables for all devices, except 3D printers and Wide Format devices, with support and maintenance cover including toner and staples. 18.3. The Contractor shall ensure that all Consumables are available for each device at least seven (7) years after manufacture of the device ends. The Contractor shall ensure that all consumables products supplied under the Framework Agreement meet all relevant legislation at the time of installation. 18.4. Consumables will be required to be ordered by the Framework Public Body along with the initial product order. The Contractor is required to deliver the consumables within 2 Working Days of delivering and installing the product. Further orders for consumables will be issued by the Framework Public Body throughout the product life. Additional orders can be submitted in an electronic format by referencing the product serial number. All additional orders are required to be delivered within 5 Working Days. 18.5. The Contractor will have a system for collection and return of spent bottles and cartridges. This system may similarly apply to other waste e.g. waste toner, developer liquids and powders, replaceable units such as fusers or developers. These collection services are to be provided at a minimum cost to the Framework Public Body.

Consumables. This Agreement does not cover the cost of any consumables, including but not limited to oils, coolants, fluids and lubricants, which are replaced during the course of repairs. Any items not listed as covered, and all excluded items, under this clause 2 are expressly excluded from the warranty provided by Xxxxxx under this Agreement.

Consumables. The Contractor shall allow in his tender price for any consumables that might be required for the execution of the work.

Consumables. Subject to the terms and conditions of this Agreement (including without limitation the restrictions in Section 5), Customer’s purchase of TG Consumables, Temporary Consumables, and Non-TG Consumables under this Agreement confers upon Customer […***…]. The Parties agree that the first sentence of this Section 3(a) is designed to and does alter the effect of the exhaustion of patent rights that would otherwise result if the sale was made without restriction. Except as expressly stated in this Section 3(a) with respect to Core IP, no right or license under any Illumina Intellectual Property Rights is or are granted, expressly, by implication, or by estoppel, to Customer under this Agreement. Any use of the Consumables recited in subparts (i) and (ii) herein outside the scope of rights expressly granted to Customer in this Section 3(a) is a prohibited use and is a breach of this Agreement. Customer agrees that it will not use any such Consumable for a prohibited use. Product recited in subparts (i) and (ii) herein may be covered by one or more U.S. or foreign patents.

Consumables. If Customer also purchases consumables from Alaris under this Agreement, Alaris will provide consumables in an amount equal only to a manufacturer- recommended one-year supply, without charge to the Customer. Customer must purchase all requirements for consumables beyond such one-year supply at the prices charged by Xxxxxx. Any Agreement including consumables is a fixed term contract and may not be cancelled by Customer at any time prior to the end of the term, except in the case of a breach by Xxxxxx.
