Common use of Payments in Excess of Workers’ Compensation Clause in Contracts

Payments in Excess of Workers’ Compensation. Employees who are covered by Workers’ Compensation shall continue to receive during the period of their absence from duty because of: disability resulting from personal injuries arising out of and in the course of their employment; or arising out of ordinary risks of the street while actually engaged, with the authorization of the City in the business affairs or undertakings of the City; or during the period of their absence from duty because of disability resulting from sickness or illness arising out of and in the course of their employment; the difference between their regular compensation and the amount being received by them under the Workers’ Compensation Act. Amounts received hereunder shall be subject to the provisions of the foregoing section governing sick leave benefits. No employee of the City shall receive benefits hereunder in excess of the unused portion of any sick leave to which he may be entitled under the foregoing paragraph. Payments hereunder shall be charged against the unused portion of sick leave benefits as follows: Per diem amount received hereunder X Number of days for which Per diem regular compensation compensation benefits have been received
