Pension Benefits. Pension benefits for an employee covered by this Agreement who is a member of the Employees' Retirement System of Milwaukee (ERS) shall be the benefits defined in Chapter 36 of the Milwaukee City Charter that are applicable to a "policeman." Except as provided below, these pension benefits shall continue unchanged during the term of this Agreement. 1. Chapter 36 of the Milwaukee City Charter regarding pension benefits for employees covered by this Agreement who are members of the Employees' Retirement System of Milwaukee (ERS) may be amended to the extent necessary for such plan to remain qualified under Section 401(a) and 501(c) of the Internal Revenue Code of 1986 as amended. 2. The City agrees that it will never seek to increase the age/service requirements applicable to employees in active service and enrolled in the Employees’ Retirement System as “policemen” prior to December 20, 2016 that are provided for under section 36.05(1)(f) of the ERS Act. Effective Pay Period 1, 2016, an employee newly eligible for service credit as a “policemen” in the Employees’ Retirement System will be eligible for a normal service retirement benefit no earlier than age 50 with twenty-five years of service as a “policemen”. 3. Employees who are entitled to service credit as a "policeman" under the Employee's Retirement System of Milwaukee pension plan shall receive such service credit at the rate of 2.5% per annum of Final Average Salary for all such years or parts thereof. 4. If any portion of the Global Pension Settlement Agreement or implementing Charter Ordinance is held invalid, or if compliance with it is restrained by operation of law or by any court of competent jurisdiction, the parties shall immediately enter into collective bargaining for the purpose of arriving at a mutually satisfactory replacement for such portion of the Global Pension Settlement Agreement or Charter Ordinance. This paragraph shall in no way affect or restrict other benefits unrelated to pension benefits in the Global Settlement Agreement. 6. Creditable service for active military service, as provided in 36-04-c, shall be extended to members of the MPSO who participate in the combined fund and who retire on a service retirement on and after January 1, 2003. 7. Effective January 1, 2016, when a retirement application is filed by an employee covered by this Agreement who seeks a Duty Disability Retirement Allowance, the application shall be referred to the Medical Council established under s. 36-15-12 of the Milwaukee City Charter. The Medical Council shall determine and certify whether the applicant is permanently and totally incapacitated for duty in accordance with the requirements of Chapter 36 of the Milwaukee City Charter. In any reexamination authorized by Chapter 36 of the Milwaukee City Charter of such retired beneficiary, the beneficiary shall be referred to the Medical Council for reexamination and such Medical Council shall make the determination and certification required under the provisions of Chapter 36 of the Milwaukee City Charter for reexaminations.

Effective Pay Period 1, 2015 (December 21, 2014), firemen enrolled as members of the retirement system, and for whom the city had made the member contribution on their behalf, shall contribute 3.5% of their earnable compensation toward the member contribution. Commencing Pay Period 1, 2016 (December 20, 2015), such firemen shall contribute 7.0% of their earnable compensation established as the member contribution. Solely for purposes of the global pension settlement, employees who are on a medical leave of absence on January 1, 2000, and other like situations as mutually agreed to by the City and the Union, shall be considered to be in active service on January 1, 2000. The , in 22 lieu of the Medical Panel, which Medical Council shall determine and certify 23 whether the applicant is permanently and totally incapacitated for duty as a result 24 of such mental injury in accordance with the requirements of Chapter 36 of the 25 Milwaukee City Charter. ". Except as provided belowfor 14 the following provisions, these pension benefits shall continue unchanged during the term 15 of this Agreement.:
16 1. Chapter 36 of the Milwaukee City Charter regarding pension benefits for employees covered by this Agreement who are members of the Employees' 18 Retirement System of Milwaukee (ERS) may be amended to the extent necessary 19 for such plan to remain qualified under Section 401(a) 401.a. and 501(c) 501.c. of the Internal 20 Revenue Code of 1986 as amended. In the event the IRS rules that the Charter 21 amendments have become invalid, then the Charter Ordinance will reflect back to 22 the old language of the Charter.
23 2. The City agrees that it will never seek to increase the age/service requirements 24 applicable to employees in active service and enrolled in covered by the Employees’ Retirement System as “policemen” prior to December 20, 2016 2010-2012 City/MPA 1 Labor Agreement on its effective date that are provided for under section 36.05(1)(f) 36-05-1-f 2 of the ERS Act. Effective Pay Period 1, 2016, an employee newly eligible for service credit as a “policemen” in the Employees’ Retirement System will be eligible for a normal service retirement benefit no earlier than age 50 with twenty-five years of service as a “policemen”.
3 3. Employees who are entitled to service credit as a "policeman" under the Employee's Retirement System of Milwaukee pension plan shall receive such service credit at the rate of 2.5% per annum of Final Average Salary for all such years or parts thereof.
4. Effective Pay Period 1, 2016, employees enrolled in the Employees’ Retirement System as a “policemen” prior to October 3, 2011, shall contribute 7% of their earnable compensation toward the member contribution for their pension.
5. Subject to the conditions contained therein, the parties agree to abide by the 4 pension provisions of the October 29, 1999 Final Global Settlement Agreement for 5 Active Police Officers, as amended by Charter Ordinance. 6 If any portion of the Global Pension Settlement Agreement or implementing 7 Charter Ordinance is held invalid, or if compliance with it is restrained by 8 operation of law or by any court of competent jurisdiction, the parties shall 9 immediately enter into collective bargaining for the purpose of arriving at a 10 mutually satisfactory replacement for such portion of the Global Pension 11 Settlement Agreement or Charter Ordinance. 12 This paragraph shall in no way affect or restrict other benefits unrelated to pension 13 benefits in the Global Settlement Agreement.
614 4. Creditable service for active military service, as provided in 36-04-c, shall be 15 extended to members of the MPSO MPA who participate in the combined fund and who 16 retire on a service retirement on and after January 1, 2003.
717 5. Effective January 1, 2016for employees hired after the execution date of the 2004-2006 City- 18 Association labor agreement, when a retirement application is filed by an 19 employee covered by this Agreement who seeks a Duty Disability Retirement Allowance20 Allowance based upon a mental injury, the application shall be referred to the 21 Medical Council established under s. 36-15-12 of the Milwaukee City Charter. The , in 22 lieu of the Medical Panel, which Medical Council shall determine and certify 23 whether the applicant is permanently and totally incapacitated for duty as a result 24 of such mental injury in accordance with the requirements of Chapter 36 of the 25 Milwaukee City Charter. In any reexamination authorized by Chapter 36 of the 26 Milwaukee City Charter of such retired beneficiary, the beneficiary shall be 27 referred to the Medical Council Council, in lieu of the Medical Panel, for reexamination 1 and such Medical Council shall make the determination and certification required 2 under the provisions of Chapter 36 of the Milwaukee City Charter for 3 reexaminations.
