Pension System Reportability. It is the understanding of the Parties that the Therapists performing services under this Agreement are not eligible to participate in the Teachers’ Retirement System (“TRS”) or the Illinois Municipal Retirement Fund (“IMRF”) because they 1) do not hold an educator license, and/or 2) are not employees of the District and do not individually hold independent contractor agreements directly with the District, and/or 3) are working for the District under an agreement with and are employed by a recruiting firm for the provision of substitute teacher services within the meaning of Section 2-3.173 of the School Code. If the services to be provided by Therapists constitute substitute teaching services, the Provider affirms that it will hold an employment relationship with those teachers rather than an independent contractor arrangement. However, upon notification by the District to Provider that the District has been notified by a pension system or has otherwise made a determination that an individual performing services is covered by TRS, IMRF (or another state pension system for which contributions are required), Provider and District shall negotiate any changes to fees to address financial responsibility for employer contributions to such pensions system, and Provider shall cooperate with the District in obtaining completion of necessary forms related to pension enrollment and remittances. The District shall not be liable to Provider or any Therapist for any determination regarding eligibility for participation in any pension system or for the accuracy of calculation or remittance of contributions amounts to the pension system on behalf of such individuals or Provider.
