Common use of Performance of Government Functions Clause in Contracts

Performance of Government Functions. Notwithstanding anything in this Agreement to the contrary, nothing contained in this Agreement shall in any way stop, limit or impair the CITY from exercising or performing any regulatory, policing, legislative, governmental or other powers or functions that it may have with respect to the Property nor shall anything in this Agreement constitute or imply approval or special handling and/or consideration for or exemption from any permit by any regulatory authorities of the CITY.

Notwithstanding anything in this Agreement which may be to the contrary, nothing contained in this Agreement shall in any way stopestop, limit or impair the CITY City from exercising or performing any regulatory, policing, legislative, governmental or other powers or functions that it may have with respect to the Property nor shall anything in this Agreement constitute Premises or imply approval or special handling and/or consideration for or exemption from any permit otherwise, including, by any regulatory authorities way of illustration but not limitation, inspection of the CITYPremises in the performance of such functions and exercise of the power of eminent domain with respect to the Premises.
