Permitted License Uses and Restrictions. (a) Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to use the Software solely on the designated model(s) of Digital Check or Smart Source branded devices purchased from Digital Check or its authorized resellers (“Approved Devices”) and, as applicable, on your associated workstations (including computers, tablets, and other mobile devices) and/or your networks, which are in either case solely within your control, and in every case solely for purposes of using the Approved Devices. This License does not grant you any rights to use the Software or other Digital Check proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other devices and accessories, or software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from Digital Check. (b) Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to download Software and Updates that may be made available by Digital Check for your model(s) of the Approved Devices to update or restore the Software on or for any such Approved Device that you own, control, or support on behalf of the end user of the Device. This License does not allow you to update or restore any Software for a device that you do not control or own. (c) You may not, and you agree not to or enable others to, copy (except as expressly permitted by this License), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the Software or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or by licensing terms governing use of open-source components that may be included with the Software). You have the right to make copies of the Software for archival purposes; however such copies remain subject to the terms and conditions of this License; and must include all trademark, copyright, patent, and other notices and legends contained in the original. (d) You agree to use the Software in compliance with all applicable laws, including local laws of the country(ies) or region(s) in which you reside and in which you download and use the Software. Features of the Software may not be available in all languages or regions, some features may vary by region, and some may be restricted or unavailable. (e) You shall not directly or indirectly (i) remove, delete, alter, or obscure any copyright, trademark, patent, or other intellectual property or proprietary rights notices provided on or with the Software; (ii) use the Software to cause immediate, material or ongoing harm; (iii) remove, disable, circumvent, or otherwise create or implement any workaround to any technical limits or technological copy protection or other security features of the Software; (iv) publish the Software for others to copy, except in connection with permitted use of Approved Devices (provided the Software must be the most current version available from Digital Check, including all available Updates); or (v) use the Software for purposes of competitive analysis of the Software, the development of a competing software product or service, or any other purpose that is to Digital Check's commercial disadvantage.

Except as permitted in Section 2 (b) of Digital Check or Smart Source branded devices purchased from Digital Check or its authorized resellers (“Approved Devices”) and, as applicable, on your associated workstations (including computers, tabletsbelow, and other mobile devices) and/or your networksexcept as provide in a separate agreement between you and SWAG, which are in either case solely within your controlthis License does not allow the Software to exist on more than one device at a time, and in every case solely for purposes of using you may not distribute or make the Approved DevicesSoftware available over a network where it could be used by multiple devices at the same time. This License license does not grant you any rights to use the Software or other Digital Check SWAG proprietary interfaces and other intellectual property propriety in the design, development, manufacture, licensing or distribution of other third party devices and accessories, or third party software applications, applications for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from Digital CheckApplication. (b) Subject to the terms and conditions of this License, you are granted a limited non-non exclusive license to download Software and Updates that may be made available by Digital Check SWAG for your model(s) model of the Approved Devices device to update or restore the Software software on or for any such Approved Device device that you own, own or control, or support on behalf of the end user of the Device. This License does not allow you to update or restore any Software for a device Application that you do not control or own, and you may not distribute or make the Software Updates available over a network where they could be used by multiple devices or multiple computers at the same time. (c) You may not, and you agree not to or enable others to, copy (except as expressly permitted by this License), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative derivatives works of the Software or any part thereof (except as and only to the extent extend any foregoing restriction is prohibited by applicable law or by licensing terms governing use of open-open source components that may be included with the Software). You have agree not to remove, obscure or alter any proprietary notices (including trademark and copyright notices) that may be affixed to or contained within the right to make copies of the Software for archival purposes; however such copies remain subject to the terms and conditions of this License; and must include all trademark, copyright, patent, and other notices and legends contained in the originalSoftware. (d) The Software may be used to reproduce materials so long as such use is limited to reproduction of non copyrighted materials, materials in which you own the copyright, or material you are authorized or legally permitted to reproduce. Title and intellectual propriety rights in and to any content displayed by, stored on or accessed through your Application belong to the respective content owner. Such content may be protected by copyright or other intellectual propriety laws and treaties and may be subject to terms of use of the third party providing such content. Except as otherwise provided herein, this License does not grant you any rights to use such content nor does it guarantee that such content will continue to be available to you. (e) You agree to use the Software and Services (as defined in section 5 below) in compliance with all applicable laws, including local laws of the country(ies) countries or region(s) region in which you reside and or in which you download and or use the Softwaresoftware and services. Features of the Software and the Services may not be available in all languages or and regions, some features may not be available or may vary by based on age or region, and some may be restricted or unavailableunavailable from your service provider. An ID is also required to download apps, alter, or obscure any copyright, trademark, patent, or other intellectual property or proprietary rights notices provided on or with the Software; (ii) use the Software to cause immediate, material or ongoing harm; (iii) remove, disable, circumvent, or otherwise create or implement any workaround to any technical limits or technological copy protection or other security access app updates and certain features of the Software; (iv) publish Software and Services. In addition you acknowledge that many features and Services of the Software for others to copy, except in connection with permitted use of Approved Devices (provided the Software must be the most current version available from Digital Checktransmit and receive data, including all available Updates); or app downloads and updates, and could impact charges to your data plan. Accordingly, you are responsible for any such charges. You can control which applications are permitted to use cellular data and view an estimate of how much data such application have consumed under Cellular Data Settings. For more information, please consult the User Guide for your Application. (vg) use Using Application in some circumstances can distract you and may cause a dangerous situation. By using the Software application you agree that you are responsible for purposes observing rules applicable to your country of competitive analysis of the Software, the development of a competing software product or service, or any other purpose that is to Digital Check's commercial disadvantageresidence.

This License does not grant you any rights to use the Software or other Digital Check ST Imaging proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other devices and accessories, or software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from Digital CheckST Imaging. (b) b. Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to download Software and Updates that may be made available by Digital Check ST Imaging for your model(s) of the Approved Devices to update or restore the Software on or for any such Approved Device that you own, control, or support on behalf of the end user of the Device. Subject to the terms and conditions of this LicenseLicense and as permitted in the "App Store Product Usage Rules" set forth in the App Store Terms and Conditions, you are granted a limited non-exclusive non- transferable license to install and use the Apple Software solely on any compatible Apple-branded iOS device (including, but not limited to iPhone, iPad or iPod touch) that you own or control. You may not distribute or make the designated model(s) of Digital Check Apple Software available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute or Smart Source branded devices purchased from Digital Check or its authorized resellers (“Approved Devices”) and, as applicable, on your associated workstations (including computers, tablets, and other mobile devices) and/or your networks, which are in either case solely within your control, and in every case solely for purposes of using sublicense the Approved Devices. This License does not grant you any rights to use the Software or other Digital Check proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other devices and accessories, or software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from Digital CheckApple Software. (b) Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to download Software and Updates that may be made available by Digital Check for your model(s) of the Approved Devices to update or restore the Software on or for any such Approved Device that you own, control, or support on behalf of the end user of the Device. D. Use of and access to certain features of the Software; Apple Software and certain Services (ivdefined below) publish the Software may require you to apply for others to copya unique user name and password combination, except in connection with permitted use of Approved Devices (provided the Software must be the most current version available from Digital Check, including all available Updates); or (v) use the Software for purposes of competitive analysis of the Software, the development of a competing software product or service, or any other purpose that is to Digital Check's commercial disadvantageknown as an Apple ID.
