Permitted License Uses and Restrictions. (a) Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to use the Software solely on the designated model(s) of Digital Check or Smart Source branded devices purchased from Digital Check or its authorized resellers (“Approved Devices”) and, as applicable, on your associated workstations (including computers, tablets, and other mobile devices) and/or your networks, which are in either case solely within your control, and in every case solely for purposes of using the Approved Devices. This License does not grant you any rights to use the Software or other Digital Check proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other devices and accessories, or software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from Digital Check. (b) Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to download Software and Updates that may be made available by Digital Check for your model(s) of the Approved Devices to update or restore the Software on or for any such Approved Device that you own, control, or support on behalf of the end user of the Device. This License does not allow you to update or restore any Software for a device that you do not control or own. (c) You may not, and you agree not to or enable others to, copy (except as expressly permitted by this License), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the Software or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or by licensing terms governing use of open-source components that may be included with the Software). You have the right to make copies of the Software for archival purposes; however such copies remain subject to the terms and conditions of this License; and must include all trademark, copyright, patent, and other notices and legends contained in the original. (d) You agree to use the Software in compliance with all applicable laws, including local laws of the country(ies) or region(s) in which you reside and in which you download and use the Software. Features of the Software may not be available in all languages or regions, some features may vary by region, and some may be restricted or unavailable. (e) You shall not directly or indirectly (i) remove, delete, alter, or obscure any copyright, trademark, patent, or other intellectual property or proprietary rights notices provided on or with the Software; (ii) use the Software to cause immediate, material or ongoing harm; (iii) remove, disable, circumvent, or otherwise create or implement any workaround to any technical limits or technological copy protection or other security features of the Software; (iv) publish the Software for others to copy, except in connection with permitted use of Approved Devices (provided the Software must be the most current version available from Digital Check, including all available Updates); or (v) use the Software for purposes of competitive analysis of the Software, the development of a competing software product or service, or any other purpose that is to Digital Check's commercial disadvantage.

Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to download Software and Updates that may be made available by Digital Check nextScan for your model(s) of the Approved Devices to update or restore the Software on or for any such Approved Device that you own, control, or support on behalf of the end user of the Device. This License does not allow you to update or restore any Software for a device that you do not control or own. (c) c. Permitted License Uses and Restrictions. (a) Subject to the terms and conditions of this License, you are granted a limited non-exclusive exclusive, non- sublicensable, and non-transferable license to use the eVisitor Software solely on a single computer during the designated model(sTerm of this Agreement. Except as permitted in Section 2(b) of Digital Check or Smart Source branded devices purchased from Digital Check or its authorized resellers (“Approved Devices”) and, as applicable, on your associated workstations (including computers, tabletsbelow, and other mobile devices) and/or your networksunless as provided in a separate agreement between you and THRESHOLD, which are in either case solely within your controlthis License does not allow the eVisitor Software to exist on more than one computer at a time, and in every case solely for purposes of using you may not distribute or make the Approved DeviceseVisitor Software available over a network where it could be used by multiple devices at the same time. This License does not grant you any rights to use the Software or other Digital Check THRESHOLD proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other third-party devices and accessories, or third party software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from Digital CheckeVisitor. (b) Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to download eVisitor Software and Updates that may be made available by Digital Check THRESHOLD for your model(s) of the Approved Devices you to update or restore the Software software on or for any such Approved Device computer that you own, own or control, or support on behalf of the end user of the Device. This License does not allow you to update or restore any Software for a device computer that you do not control or own, and you may not distribute or make the eVisitor Software Updates available over a network where they could be used by multiple devices or multiple computers at the same time. If you download an eVisitor Software Update to your computer, you may make one copy of eVisitor Software Updates stored on your computer in machine-readable form for backup purposes only, provided that the backup copy must include all copyright or other proprietary notices contained on the original. (c) You may not, and you agree not to or enable others to, copy (except as expressly permitted by this License), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the eVisitor Software or any services provided by the eVisitor Software or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or by licensing terms governing use of open-source components that may be included with the eVisitor Software). You have the right to make copies of the Software for archival purposes; however such copies remain subject to the terms and conditions of this License; and must include all trademark, copyright, patent, and other notices and legends contained in the original. (d) By storing content on eVisitor you are making a digital copy. In some jurisdictions, it is unlawful to make digital copies without prior permission from the rights holder. (e) You agree to use the eVisitor Software and the Services (as defined in Section 5 below) in compliance with all applicable laws, including local laws of the country(ies) country or region(s) region in which you reside and or in which you download and or use the Software. Features of the eVisitor Software may not be available in all languages or regions, some features may vary by region, and some may be restricted or unavailableServices. (ef) You shall not directly or indirectly (i) remove, delete, alter, or obscure any copyright, trademark, patent, or other intellectual property or proprietary rights notices provided on or with the Software; (ii) use the Software Use of and access to cause immediate, material or ongoing harm; (iii) remove, disable, circumvent, or otherwise create or implement any workaround to any technical limits or technological copy protection or other security certain features of the Software; eVisitor Software and certain Services (ivas defined in Section 5) publish may require you to apply for a unique user name and password combination, known as a THRESHOLD ID. In addition, you acknowledge that many features and Services of the eVisitor Software transmit data and could impact charges to your data plan, and that you are responsible for any such charges. (g) You may not, and you agree not to or enable or promote others to copyto, except in connection with permitted use of Approved Devices (provided the Software must be the most current version available from Digital Check, including all available Updates); or (v) use the eVisitor Software for purposes of competitive analysis of the Software, the development of a competing software product to collect or service, store any Protected Health Information or any other purpose that is to Digital Check's commercial disadvantageElectronic Protected Health Information as defined in 45 CFR § 160.103.

(a) Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to use the Software solely on the designated model(s) of Digital Check or Smart Source branded devices purchased from Digital Check or its authorized resellers (“Approved Devices”) and, as applicable, on your associated workstations (including computers, tablets, and other mobile devices) and/or your networks, which are in either case solely within your control, and in every case solely for purposes of using the Approved DevicesXxxxxx Title Software. This License does not grant you any rights to use the Software or other Digital Check Xxxxxx Title proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other devices and accessories, third party software or third party software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from Digital Check. (b) Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to download Software and Updates that may be made available by Digital Check for your model(s) of the Approved Devices to update or restore the Software on or for any such Approved Device that you own, control, or support on behalf of the end user of the Device. This License does not allow you to update or restore any Software for a device that you do not control or own. (c) You may not, and you agree not to or enable others to, copy (except as expressly permitted by this License), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the Xxxxxx Title Software or any services provided by the Xxxxxx Title Software or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or by licensing terms governing use of open-source components that may be included with the Xxxxxx Title Software). You have agree not to remove, obscure, or alter any proprietary notices (including trademark and copyright notices) that may be affixed to or contained within the right Xxxxxx Title Software (c) The Xxxxxx Title Software may be used to make copies reproduce materials so long as such use is limited to reproduction of non-copyrighted materials, materials in which you own the copyright, or materials you are authorized or legally permitted to reproduce. Title and intellectual property rights in and to any content displayed by, stored on or accessed through your Device belong to the respective content owner. Such content may be protected by copyright or other intellectual property laws and treaties, and may be subject to terms of use of the third party providing such content. Except as otherwise provided herein, this License does not grant you any rights to use such content nor does it guarantee that such content will continue to be available to you (d) In order to complete certain app and/or website action shortcuts (“Shortcuts”), the Xxxxxx Title Software for archival purposes; however such copies remain subject may need to access certain third party software applications, services or websites on your Device (“Third Party Apps”). You expressly consent to and authorize the Xxxxxx Title Software to access and use these Third Party Apps on your behalf to the terms and conditions of this License; and must include all trademarkextent necessary to complete the Shortcut with the Xxxxxx Title Software. You agree not to upload, copyrightpost, patente-mail, and transmit, share or otherwise make available any Shortcut that is offensive, inappropriate or for any unlawful or illegal activity. To the extent that the Xxxxxx Title Software accesses any Third Party Apps, Xxxxxx Title has no express or implied obligation to provide any technical or other notices and legends contained in support for such Third Party Apps. Please contact the originalappropriate software vendor, manufacturer or service provider directly for technical support andcustomer service related to its software, service, website and/or products. YOU AGREE YOU SHALL BEBOUND BY, AND AGREE TO COMPLY WITH, ALL APPLICABLE TERMS OF SERVICE OR OTHER AGREEMENTS FOR SUCH THIRD PARTY APPS WHEN USING THE XXXXXX TITLE SOFTWARE. YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT ALL SHORTCUTS COMPLY WITH THE APPLICABLE TERMS FOR EACH THIRD PARTY APP USED BY THE SHORTCUT. XXXXXX TITLE DOES NOT GUARANTEE IN ANY WAY THAT SHORTCUTS COMPLY WITH THE TERMS FOR ANY THIRD PARTY APPS AND XXXXXX TITLE IS NOT RESPONSIBLE FOR ANY THIRD PARTY SHORTCUTS. (de) You agree to use the Xxxxxx Title Software and the Services (as defined in Section 5 below) in compliance with all applicable laws, including local laws of the country(ies) country or region(s) region in which you reside and or in which you download and use the SoftwareXxxxxx Title Software and Services. Features of the Xxxxxx Title Software and the Services may not be available in all languages or regions, some features may vary by region, and some may be restricted or unavailableunavailable from your service provider. A Wi-Fi or cellular data connection is required for some features of the Xxxxxx Title Software and Services. (ef) YOU FURTHER AGREE THAT SOME POTENTIAL APPLICATIONS OF THE XXXXXX TITLE SOFTWARE COULD CONSTITUTE VIOLATIONS OF THE TELEPHONE CONSUMER PROTECTION ACT, STATE DIVISION OF INSURANCE REGULATION, THE REAL ESTATE SETTLEMENT PROCEDURES ACT AND/OR OTHER FEDERAL OR STATE STATUTES. YOU HEREBY AGREE TO USE THE XXXXXX TITLE SOFTWARE IN ACCORDANCE WITH FEDERAL AND STATE STATUTE AND AGREE TO HOLD XXXXXX TITLE, IT ASSOCIATES AND/OR ASSIGNS HARMLESS FROM ANY AND ALL ACTIONS ARISING OUR OF ANY CAUSE, MATTER OR THING WHATSOEVER AS A RESULT OF THE USE OF THE XXXXXX TITLE SOFTWARE INCLUDING BUT NOT LIMITED TO VIOLATIONS OF FEDERAL OR STATE LAW AND/OR PRIVATE LEGAL ACTION AS A RESULT OF SUCH USE. (g) You shall not directly or indirectly acknowledge that many features and Services of the Xxxxxx Title Software transmit data and could impact charges to your data plan, and that you are responsible for any such charges. (h) Your Device will periodically check with Xxxxxx Title for updates to the apps on your Device and, if one is available, the update will automatically download and install onto your Device. (i) removeUsing your Device in some circumstances can distract you and may cause a dangerous situation (for example, delete, alter, using the “Make An Offer” feature while driving a car or obscure any copyright, trademark, patent, using headphones while riding a bicycle). By using your Device you agree that you are responsible for observing rules that prohibit or other intellectual property or proprietary rights notices provided on or with restrict the Software; (ii) use the Software to cause immediate, material or ongoing harm; (iii) remove, disable, circumvent, or otherwise create or implement any workaround to any technical limits or technological copy protection or other security features of the Software; (iv) publish the Software for others to copy, except in connection with permitted use of Approved Devices mobile phones or headphones (provided the Software must be the most current version available from Digital Check, including all available Updates); or (v) use the Software for purposes of competitive analysis of the Softwareexample, the development of a competing software product or service, or any other purpose that is requirement to Digital Check's commercial disadvantageuse hands-free options for making calls when driving).

This License does not grant you any rights to use the Software or other Digital Check ST Imaging proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other devices and accessories, or software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from Digital CheckST Imaging. (b) b. Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to download Software and Updates that may be made available by Digital Check ST Imaging for your model(s) of the Approved Devices to update or restore the Software on or for any such Approved Device that you own, control, or support on behalf of the end user of the Device. Permitted License Uses and Restrictions. (a) Subject to the terms and conditions of this License, This SLA allows you are granted a limited non-exclusive license to use the Software solely Application on the designated model(s) of Digital Check any Supported Device that you, own or Smart Source branded devices purchased from Digital Check or its authorized resellers (“Approved Devices”) and, as applicable, on your associated workstations (including computers, tablets, and other mobile devices) and/or your networks, which are in either case solely within your control, and in every case solely for purposes of using the Approved Devices. This License does not grant you any rights to use the Software or on no other Digital Check proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other devices and accessories, or software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from Digital Checkdevices. (b) Subject The Application is available for download only from the Google Play Store. You may not distribute or make the Application available over any other service. c) With respect to updates to the terms and conditions of Application that Attachmate may make available for download, this License, SLA allows you are granted a limited non-exclusive license to download Software and Updates that may be made available by Digital Check for your model(s) of the Approved Devices such Application updates to update or restore the Software Application on or for any such Approved Supported Device that you own, own or control, or support on behalf of the end user of the Device. This License SLA does not allow you to update or restore any Software for a device devices that you do not control own or owncontrol. (cd) You may not, Except as and you agree not only to or enable others to, copy (except as expressly the extent permitted by this License)applicable law, or by licensing terms governing use of open-sourced components included with the Application, neither you nor any other Company personnel may copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the Software Application or Application updates, or any part thereof (except as thereof. Any attempt to do so is a violation of the rights of Attachmate and only to its licensors. If you or any other Company personnel breach this restriction, you or they, and the extent any foregoing restriction is prohibited by applicable law or by licensing terms governing use of open-source components that Company, may be included with subject to prosecution and damages. e) Neither you nor the Software). You have Company may rent, sell, lease, lend, redistribute or sublicense the right Application, and you agree to make copies prevent unauthorized copying of the Software for archival purposes; however such copies remain subject to the terms and conditions of this License; and must include all trademark, copyright, patent, and other notices and legends contained in the originalApplication. (e) You shall not directly or indirectly (i) remove, delete, alter, or obscure any copyright, trademark, patent, or other intellectual property or proprietary rights notices provided on or with the Software; (ii) use the Software to cause immediate, material or ongoing harm; (iii) remove, disable, circumvent, or otherwise create or implement any workaround to any technical limits or technological copy protection or other security features of the Software; (iv) publish the Software for others to copy, except in connection with permitted use of Approved Devices (provided the Software must be the most current version available from Digital Check, including all available Updates); or (v) use the Software for purposes of competitive analysis of the Software, the development of a competing software product or serviceU.S. State Department, or any other purpose export laws, restrictions, or regulations of any jurisdiction. You warrant and represents that is to Digital Check's commercial disadvantageneither the U.S. Bureau of Export Administration nor any other U.S. agency has suspended, revoked, or denied your export privileges.

Except as permitted in Section 2(b) of Digital Check or Smart Source branded devices purchased from Digital Check or its authorized resellers (“Approved Devices”) and, as applicable, on your associated workstations (including computers, tabletsbelow, and other mobile devices) and/or your networksunless as provided in a separate agreement between you and the Company, which are in either case solely within your controlthis License does not allow the FGC-OS Software to exist on more than one DA Device at a time, and in every case solely for purposes of using you may not distribute or make the Approved DevicesFGC-OS Software available over a network where it could be used by multiple devices (whether another DA Device or other device) at the same time. This License does not grant you any rights to use the Software or other Digital Check any proprietary interfaces and other intellectual property in the design, development, manufacture, licensing licensing, or distribution of other third-party devices and accessories, or third-party software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from Digital CheckFGC-OS Devices. (b) Subject to the terms and conditions of this License, you are granted a limited non-non- exclusive license to download FGC-OS Software and Updates that may be made available by Digital Check for your model(s) of the Approved Devices Company to update or restore the Software software on or for any such Approved Device that you own, control, or support on behalf of the end user of the your DA Device. This License does not allow you to update or restore any Software for a device DA Device that you do not control or own, and you may not distribute or make the FGC-OS Software Updates available over a network. (c) You may not, and you agree not to or enable others to, copy (except as expressly permitted by this License), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the FGC-OS Software or any services provided by the FGC-OS Software or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or by licensing terms governing use of open-source components that may be included with the FGC-OS Software). You have the right to make copies of the Software for archival purposes; however such copies remain subject to the terms and conditions of this License; and must include all trademark, copyright, patent, and other notices and legends contained in the original. (d) Title and intellectual property rights in and to any content displayed by, stored on, or accessed through your DA Device belong to the respective content owner. Further, you understand that the performance of Licensed Software and Services requires adequate broadband internet connectivity to enable the transmission and receipt of data and communications content, and individual wireless carriers may use or its authorized resellers (“Approved Devices”) andimplement various broadband data restrictions, as applicablethrottling, on rationing, congestion mitigation or denial schemes and methods to limit broadband data utilization and throughput which may compromise or interfere with the use or operation of the Licensed Software and Services. C. By using the Licensed Software and Services, you agree that Mutualink and the Master Licensee may use and store your associated workstations (application access credentials and other information that you provide, including computersunique account identifiers, tabletspasswords, identifying information for the purpose of authenticating and validating your user identity, your access privileges, and other mobile devices) and/or your networks, which are in either case solely within your control, and in every case solely for purposes of using the Approved Devices.
