Common use of Personal Information and Privacy Requirements Clause in Contracts

Personal Information and Privacy Requirements. A State Fund, CalHR, and Department Responsibilities: (1) State Fund, CalHR, and Departments shall not use or disclose any Personal Information it receives for any purpose other than carrying out the terms of this Agreement or as required by Law. (2) State Fund, CalHR, and Departments, shall implement and maintain safeguards for the Personal Information it receives consistent with the requirements of Section 9.1 and all applicable Laws, including Privacy Laws, in order to (a) ensure the security and confidentiality of the Personal Information; (b) protect against anticipated threats or hazards to the security or integrity of such Personal Information; (c) protect against unauthorized access to or disclosure or use of such Personal Information; and (d) protect against accidental or unlawful destruction or accidental loss or alteration of such Personal Information. (3) State Fund, CalHR, and Departments, shall (a) limit access to and possession of Personal Information only to those Personnel whose responsibilities under this Agreement reasonably require such access or possession; and (b) take appropriate action to cause such Personnel to be advised of the terms of this Section and cause Personnel to attend training with respect to their handling of Personal Information.
