Common use of Personnel and Labour Clause in Contracts

Personnel and Labour. (a) The Authorisee shall (i) be solely and exclusively responsible for the recruitment, transportation, accommodation, catering, payment of the salaries, wages and other payments and costs incidental thereto, health, hygiene, safety etc. and all taxes, charges, levies, duties payable under Applicable Laws arising from the respective terms and conditions of employment of all labour and personnel employed by the Authorisee, its Contractors, agents and representatives on or in connection with the Works or the Project Site under or through whatever legal relationship; (ii) make efforts to maintain harmony and good industrial relations among the labour and personnel employed in connection with the performance of the Authorisee's obligations under this Agreement and be the principal employer in respect of such labour and personnel. The Authorisee shall be solely responsible and liable for compliance with all Applicable Laws, including labour and local laws, pertaining to the employment of labour, staff and personnel by it and its Contractors for implementing the Project. The employees of the Authorisee and its Contractors shall at all times be the responsibility of the Authorisee and the Grantor shall not be liable in any manner whatsoever in respect of such employees and their employment.

Personnel and Labour. (a) The Authorisee shall (i) be solely appoint and exclusively responsible retain the key personnel and team leader as required for the recruitment, transportation, accommodation, catering, payment smooth functioning of the salariesProject. In the event the Concessionaire is required by the Concessioning Authority to remove or change any key personnel, wages it shall forthwith provide as replacement a Person of equivalent or higher qualifications acceptable to the Concessioning Authority; (ii) provide the requisite training related to the handling and other payments and costs incidental thereto, health, hygiene, safety etc. and management of MSW to all taxes, charges, levies, duties payable under Applicable Laws arising from persons (the respective terms and conditions of employment of all labour and personnel employed by of the AuthoriseeConcessionaire, its Contractors, agents and representatives on or in connection with the Works otherwise) employed or working at the Project Site under or through whatever legal relationshipFacilities; (iiiii) make efforts to maintain harmony and good industrial relations among the labour and personnel employed in connection with the performance of the AuthoriseeConcessionaire's obligations under this Agreement and be the principal employer primary employer, vis-a-vis the Concessioning Authority in respect of such labour and personnel. The Authorisee shall ; (iv) be solely responsible and liable for compliance with all Applicable Laws, including labour and local laws, pertaining to the employment of labour, staff and personnel by it and its Contractors for implementing the Project. The employees of the Authorisee and its Contractors shall ; (v) at all times be the responsibility of the Authorisee responsible for its employees and Contractors and the Grantor Concessioning Authority shall not be liable in any manner whatsoever in respect of such employees and their employment.
