Common use of Phone Services Clause in Contracts

Phone Services. All telephone, and electric connections which Tenant may desire shall be first approved by Landlord in writing (such approval not to be unreasonably withheld or delayed), before the same are installed, and the location of all wires and the work in connection therewith shall be performed by contractors chosen by Tenant and approved by Landlord in writing (such approval not to be unreasonably withheld or delayed) and shall be subject to the direction of Landlord. Landlord reserves the right to reasonably approve the entity or entities providing telephone or other communication cable installation, repair and maintenance services to Tenant and to reasonably restrict and control access to telephone cabinets. Tenant shall be responsible for and shall pay all costs incurred in connection with the installation of telephone cables and related wiring in the Premises, including, without limitation, any hook-up, access and maintenance fees related to the installation of such wires and cables in the Premises and the commencement of service therein, and the maintenance thereafter of such wire and cables; and there shall be included in Operating Expenses for the Building all installation, hook-up or maintenance costs incurred by Landlord in connection with telephone cables and related wiring in the Building which are not allocable to any individual users of such service but are allocable to the Building generally. If Tenant fails to maintain all telephone cables and related wiring in the Premises and such failure affects or interferes with the operation or maintenance of any other telephone cables or related wiring in the Building, Landlord or any vendor hired by Landlord may enter into and upon the Premises forthwith and perform such repairs, restorations or alterations as Landlord deems necessary in order to eliminate any such interference (and Landlord may recover from Tenant all of Landlord’s costs in connection therewith). Upon the Termination Date, Tenant agrees to remove all telephone and computer cables and related wiring installed by Tenant for and during Tenant’s occupancy, which Landlord shall request Tenant to remove. Tenant agrees that neither Landlord nor any of its agents or employees shall be liable to Tenant, or any of Tenant’s employees, agents, customers or invitees or anyone claiming through, by or under Tenant, for any damages, injuries, losses, expenses, claims or causes of action because of any interruption, diminution, delay or discontinuance at any time for any reason in the furnishing of any telephone service to the Premises and the Building. If in connection with the foregoing, Tenant requires any cabling outside of the Premises, the specific location of such cabling shall be as prescribed by Landlord and, other than reasonably necessary cabling between the portions of the Premises located on different floors the Building, such cabling shall be subject to availability restrictions reasonably imposed by Landlord taking into account the needs of Landlord and other tenants and users of the Building.

Tenant shall be responsible for and shall pay all costs incurred in connection with the installation of telephone cables and related wiring in the Premises, including, without limitation, any hook-up, access and maintenance fees related to the installation of such wires and cables in the Premises and the commencement of service therein, and the maintenance thereafter of such wire and cables; and there shall be included in Operating Expenses for the Building all installation, hook-up or maintenance costs incurred by Landlord in connection with telephone cables and related wiring in the Building which are not allocable to any individual users of such service but are allocable to the Building generally. If in connection with Building unless caused by the foregoing, Tenant requires any cabling outside of the Premises, the specific location of such cabling shall be as prescribed by Landlord and, other than reasonably necessary cabling between the portions of the Premises located on different floors the Building, such cabling shall be subject to availability restrictions reasonably imposed by Landlord taking into account the needs negligent acts or omissions or willful misconduct of Landlord and other tenants and users or that of the Buildingits agents or employees.

Tenant agrees that neither Landlord nor any of its agents or employees shall be liable to Tenant, or any of Tenant’s 's employees, agents, customers or invitees or anyone claiming through, by or under Tenant, for any damages, injuries, losses, expenses, claims or causes of action because of any interruption, diminution, delay or discontinuance at any time for any reason in the furnishing of any telephone service to the Premises and the Building.
