Common use of Pipeline Penalties Clause in Contracts

Pipeline Penalties. In the event of (i) an Imbalance on Buyer's Transporter caused by Seller's or Seller's Transporter's delivery of less or more than the quantity which Buyer properly nominated for any Day (in which case Seller shall be deemed to be the "Responsible Party"), or (ii) an Imbalance on Seller's Transporter caused by Buyer's or Buyer's Transporter's receipt of more or less than the quantity which Seller properly delivered for any Day (in which case Buyer shall be deemed to be the "Responsible Party"), the Responsible Party will be liable to the other Party for any associated pipeline penalties.

Pipeline Penalties. In the event of (i) an Imbalance on Buyer's Transporter caused by Seller's or Seller's Transporter's delivery of less or more than the Scheduled quantity which Buyer properly nominated for any Day (in which case Seller shall be deemed to be the "Responsible Party"), or (ii) an Imbalance on Seller's Transporter caused by Buyer's or Buyer's Transporter's receipt of more or less than the Scheduled quantity which Seller properly delivered for any Day (in which case Buyer shall be deemed to be the "Responsible Party"), the Responsible Party will be liable to the other Party for any associated pipeline Pipeline penalties including, without limiting the generality of the foregoing, Pipeline Scheduling penalties, monthly imbalance penalties and/or cash-out premiums, and unauthorized overrun charges.
