Common use of Planned Improvements Clause in Contracts

Planned Improvements. The Developer has divided the installation of the required Improvements into 1 phases. The Developer shall, in conjunction with each phase, and at its sole cost and expense, complete the road construction, install entrance and street signs, install telephone and electrical service, install fire protection, install approved landscaping, stabilized and re-seed areas of the Property disturbed by installation of Improvements, and complete all other required infrastructure for each phase as detailed in the Settler's Place Improvement plans dated , 20 21 _ , recorded in the Teton County Clerk and Recorders office on , 20 21 _. Such Improvements shall be constructed so that each phase is “stand alone” in terms of providing Improvements to the lots and units in that phase. Developer agrees that such Improvements shall be installed in compliance with Teton County’s Title 9 and any design and engineering standards separately adopted by the County or other agencies responsible for providing services to the Development. The Settler's Place ’s estimated cost to complete all Improvements as of September 24 , 20 21 is shown in Exhibit B of this Agreement. The Developer shall obtain an updated cost estimate within ninety (90) days prior to obtaining its Letter of Credit and starting construction of any Improvements in every phase, as set forth in Section 8 hereof. The phasing plan for the Development is shown in Exhibit C of this Agreement.
