Common use of Policy Election Clause in Contracts

Policy Election. OP shall operate in accordance with the District’s Charter Policy specified in Addendum A-1 and other policies specified in Xxxxxxxx X-0, as they currently exist or as they may be amended, so long as any such amendment does not constitute a Material Breach of this Agreement. If both Parties agree that an amendment amounts to a Material Breach, then the Parties may agree to operate under a prior (non-amended) policy so long as the prior policy is in compliance with the then-current Applicable Laws.
