Position Application, Transfers and Discipline. A nurse who is not involved in a disciplinary process may apply for and transfer to another unit in accordance with the terms of this article. A nurse, however, who is involved in a disciplinary process may transfer to another unit only if the manager of that unit so agrees. Involvement in a disciplinary process under this paragraph shall be defined as (1) having been notified of being under investigation for possible discipline prior to being awarded the position, (2) being subject to a work correction plan imposed pursuant to a disciplinary action, or (3) having received disciplinary action within the previous twelve (12) months.
