Position to Which Teacher Returns. Upon a teacher's return to work, the School Corporation shall assign the teacher to the same position held by such teacher when leave commenced or to a substantially similar position, except in the following instances: (1) Where the position and such substantially similar position have been filled by a teacher pursuant to a temporary or regular teaching contract; (2) Where the return is within six (6) weeks of the end of a semester. In either such event, the teacher shall be assigned a teaching position in the following order of preference: to any available position for which the teacher is qualified, or to a position as a full-time substitute.
