Common use of Possession and Control of Electric Energy Clause in Contracts

Possession and Control of Electric Energy. For purposes of indemnification, the Company shall be deemed to possess and control the electric energy produced by the Supplier upon receipt thereof (at the Company's distribution facility, at the PJM bus, or at the point of receipt as it may otherwise be defined by the Applicable Legal Authorities), until the electric energy is delivered to the Customer or for the Customer's account at the point of delivery (at the Customer's meter, or at the point of delivery as it may otherwise be defined by the Applicable Legal Authorities). The Supplier shall be deemed to possess and control the electricity prior to such receipt by the Company. Subject to the provisions of this Article, the Party in possession and control (the "Indemnifying Party") will indemnify the other Party (the "Indemnified Party") for liability arising out of such possession and control.
