Common use of Possession by the Allottee Clause in Contracts

Possession by the Allottee. After obtaining the completion occupancy certificate* and handing over physical possession of the Apartment/Pent Houses [Apartment/ROW- HOUSE] to the Allottees, it shall be the responsibility of the Promoter to hand over the necessary documents and plans, including common areas, to the association of Allottees or the competent authority, as the case may be, as per the local laws. [Provided that, in the absence of any local law, the promoter shall handover the necessary documents and plans, including common areas, to the association of allottees or the competent authority, as the case may be, within thirty days after obtaining the completion certificate].

Possession by the Allottee. (s) – After obtaining the occupancy certificate / completion occupancy certificate* certificate and handing over physical possession of the Apartment/Pent Houses [Apartment/ROW- HOUSE] Apartment to the AllotteesAllottee(s), it shall be the responsibility of the Promoter to hand over the necessary documents and plans, including common areas, to the association of Allottees Allottee(s) on its formation and registration or the competent authority, as the case may be, as per the local laws. Possession by the Allottee. After obtaining the completion occupancy certificate* Occupancy cum Completion Certificate (by whatever name called) and handing over physical possession of the Apartment/Pent Houses [Apartment/ROW- HOUSE] Apartment to the Allotteesallottee(s), it shall be the responsibility of the Promoter to hand over the necessary documents and plans, including common areasCommon Areas, to the association of Allottees allottees or the competent authority, as the case may be, as per the local laws. Possession by the Allottee. After obtaining the completion completion/occupancy certificate* certificate and handing over physical possession of the Apartment/Pent Houses [Apartment/ROW- HOUSE] Residential Unit to the Allottees, it shall be the responsibility of the Promoter to hand over the necessary necessary-documents and plans, including common areas, to the association Association of Allottees or the competent authority, as the case may be, as per the local laws. [Provided that, in the absence of any local law, the promoter Promoter shall handover hand over the necessary documents and plans, including common areasCommon Areas, to the association Association of allottees Allottees or the competent authority, as the case may be, within thirty 30 (thirty) days after obtaining the completion certificate].

Possession by the Allottee. After obtaining the completion occupancy certificate* certificate and handing over physical possession of all the Apartment/Pent Houses [Apartment/ROW- HOUSE] Designated Apartment to the AllotteesAllottee(s), it shall be the responsibility of the Promoter to hand over handover the necessary documents and plansplan, including common areas, areas to the association Association (upon its registration) of Allottees or the competent authority, as the case may be, be as per the local laws.
