Common use of Posting Requirement Clause in Contracts

Posting Requirement. Subject to the provisions of 11.1, when a position becomes vacant through the dismissal, demotion, death, abandonment, promotion, resignation, transfer or retirement of an employee, or action by the District to create a new position, the vacancy shall be posted at all District worksites within ten (10) calendar days of establishment of the vacancy. The vacancy shall remain posted for not less than six (6) working days prior to being filled. The District may publicly advertise the vacancy concurrently with internal posting. This shall not restrict the District's ability to employ a substitute pending the filling of the vacancy, so long as the District actively seeks to fill the vacancy. One or more substitutes may temporarily be used to fill the position for a combined total not to exceed sixty (60) calendar days.
