Reassignments and Transfers. For the purpose of this Article, a vacancy occurs when there is a need in an allocated position for a teacher as a replacement as a result of expansion, retirement, or promotion. The Union shall be notified when a vacancy occurs. Notices of vacancies, which occur in classroom positions, shall be promptly posted in each building as is designated. Notices shall be posted for not less than five (5) working days in order to allow individual teachers the opportunity to bid on the position. Positions eliminated because of necessary staff reductions, declining enrollment, or a decision to alter course offerings are not considered vacancies and need not be posted. The Union shall be notified when positions are eliminated. Vacancies shall be filled first by teachers who are certified and qualified. Where applicable, qualified shall mean meeting the standards established by the North Central Association of Schools. The successful bidder will be the person most qualified. If all the applicants are equally qualified, the determining factor for awarding the position will be seniority. Because teacher qualifications in pilot programs may be unique and specialized, the Board reserves the right to deviate from the principle of seniority in awarding these positions. The Board may hire a new teacher if no eligible candidates currently employed have bid on the posted position within the bid period or if no laid off teacher meets the qualifications. This provision also includes the pilot alternative education project for high school students beginning September 1999. All teachers will be members of the Union but their work rules, reporting times for work, teaching schedules, and class offerings will be determined by the Administration in the best interests of these special students. The length of the day and number of days worked must conform to the master agreement. Teachers will participate in alternative programs on a voluntary basis. Vacancies shall be filled as they arise. The Board and the Union recognize that when vacancies occur during the school year, it may be difficult to fill them from within the district with full time positions without undue disruption to existing instructional programs. Therefore, the teacher awarded the posted position shall be notified in a timely manner, but the physical transfer of the successful bidder will occur at the beginning of the next semester. Reassignments and Transfers. It is hereby expressly understood and agreed by and between the Ecorse Federation of Teachers and the Ecorse Board of Education that the following agreements will pertain to Section 10.2.2 Reassignments and Transfers as found on pages 15 and 16 of the Agreement between the Ecorse Public Schools and the Ecorse Federation of Teachers. This Memorandum of Understanding more specifically relates to paragraph one on page 16 of the existing contract, which makes reference to teaching assignments and the equitable distribution of members of the teacher bargaining unit. It should further be added that all actions resultant from these agreements will be done in compliance with existing local policy and state and federal legislation.
Reassignments and Transfers. For the purpose of this Article, a reassignment shall mean a change in teaching subject or grade level, or to an assignment other than as a classroom teacher, and a transfer shall mean a change in teaching assignment.
1. Notices of opportunities for reassignment to other than classroom teaching positions for the next school year shall be announced according to the same procedure described above regarding promotions.
2. Notices of opportunity for reassignment or transfer to other grade levels or teaching subject assignments shall be posted periodically as they develop. a. Any vacancy which occurs will be posted and filled in accordance with Article XII, Section
12.2 without undue delay once the vacancy becomes known to the district. Any position vacated by a teacher who is awarded a vacancy shall be filled temporarily and posted within ten (10) days as a vacancy for the ensuing school year.
Reassignments and Transfers. 1. No involuntary transfer/reassignment will be made if there is a qualified volunteer to fill the necessary position.
2. The District will notify the affected employee(s) by the last day of school or in as timely a manner as possible.
3. The building principal will maintain open communication with the affected employee(s) regarding the need for the change and the process that is to be used in determining the transfer/reassignment.
4. When two or more employees are, in the District’s judgment, equally qualified, seniority (as defined in Article III, Section 2.A.6.a) shall be considered.
5. The District reserves the right to determine which employee will be transferred/reassigned.
6. Employees being transferred/reassigned will be informed of any other appropriate vacancies known at the time the transfer decision is being made. Employees will be able to indicate their preference of assignment.
7. Employees receiving a District directed transfer should be notified, in writing, by August 15th. If there is a District directed transfer after August 15th, there would be two (2) days per diem extended time pay.
8. Reassigned employees (an employee moved to a different building site and/or to a different grade level) may, at their request, solicit a review of the planned assignment and make known their wishes regarding an alternate assignment by the Superintendent or designee. A written request by an employee for this review shall be made within five (5) calendar days of the assignment notification to the employee.
Reassignments and Transfers. 11.1 Whenever an existing position becomes vacant, the District may abolish the position, modify the position, reduce the hours of position, or combine the position with another position or positions, subject only to any District obligation to bargain the salary of a reclassified position.
11.2 The District reserves the right to use the vacant position to achieve attrition by use of reassignment. If the District makes such a determination, however, it shall proceed in accordance with this subsection.
11.2.1 The District will identify the equivalent position or positions that it desires to eliminate. The incumbent(s) in those positions and CSEA will be notified of the District's intention. Any other employees who would be involved in a multiple reassignment will also be notified.
11.2.2 The District will meet with each of the affected employee(s) to discuss reassignment and to assure the suitability of the new assignment. At the request of the employee(s), a CSEA observer will be present. If training is needed to properly prepare the employee for the new duties, the training will be identified and arrangements made.
11.2.3 The Director, Human Resources/Equal Employment Officer will make the necessary reassignments and monitor any training that is arranged. If the District determines that a limited inside selection process is appropriate, the Director, Human Resources/Equal Employment Officer will determine the scope of the applicant eligibility.

These terms reflect changes that are initiated for reasons that include, but are not limited to, the following: o Vacancies that must be filled. o Changes in student enrollment at a school or in a program and/or projected changes in enrollment. o Programmatic needs. o Staffing needs. o To improve working relationships or work environments. o To accommodate employee requests and/or needs.
Reassignments and Transfers. In the determination of reassignments and transfers, the convenience and wishes of the individual employee will be considered but will always be subject to the operational needs and best interests of the school system and the pupils. The determination of said needs and interests shall be in the sole discretion of the School Committee and the School's Administration. Written acknowledgment shall be forwarded to the employee upon receipt of the request for reassignment and/or transfer.

Reassignments and Transfers. Except through the established disciplinary procedure, no employee shall be reassigned or transferred for the purpose of imposing discipline. The State and the Union shall meet in a Labor/Management Committee during the term of this Agreement to consider unit reassignment and statewide transfer practices. If the Committee reaches any conclusions concerning a plan for a modification of current reassignment and transfer practices, it shall reduce such conclusions to writing by March 1, 2002.
