Common use of Practice of Medicine Clause in Contracts

Practice of Medicine. The parties acknowledge that Business Manager is not authorized or qualified to engage in any activity that may be construed or deemed to constitute the practice of medicine. To the extent any act or service herein required by Business Manager should be construed by a court of competent jurisdiction or by the Texas State Board of Medical Examiners constitute the practice of medicine, the requirement to perform that act or service by Business Manager shall be deemed waived and unenforceable.

To the extent any act or service herein required by Business Manager should be construed by a court of competent jurisdiction or by the Texas State Board of Medical Examiners to constitute the practice of medicinemedicine by any Governmental Authority, the requirement to perform that act or service by Business Manager shall be deemed waived and unenforceable.

To the extent that any act or service herein required to be performed by Business Manager hereunder should be construed by a court of competent jurisdiction or by the Texas State Board of Medical Examiners of the States of Missouri and/or Kansas to constitute the practice of medicine, the Business Manager's requirement to perform that act or service by Business Manager shall be deemed waived and unenforceable.
