Common use of Preexisting Relationship or Experience Clause in Contracts

Preexisting Relationship or Experience. By reason of its business or financial experience, or by reason of the business or financial experience of its financial advisor who is unaffiliated with and who is not compensated, directly or indirectly, by the Company or any Affiliate or selling agent of the Company, such Member is capable of evaluating the risks and merits of an investment in the Units and of protecting its own interests in connection with this investment.

Preexisting Relationship or Experience. By (i) Such Member has a preexisting personal or business relationship with the Company or one or more of its officers, Members or control persons or (ii) by reason of its business or financial experience, or by reason of the business or financial experience of its financial advisor who is unaffiliated with and who is not compensated, directly or indirectly, by the Company or any Affiliate affiliate or selling agent of the Company, such Member is capable of evaluating the risks and merits of an investment in the Units Membership Interest and of protecting its own interests in connection with this investment.

Preexisting Relationship or Experience. By reason of its business or financial experience, or by reason of the business or financial experience of its general partner or its financial advisor who is unaffiliated with and who is not compensated, directly or indirectly, by the Company or any Affiliate affiliate or selling agent of the Company, such Member is capable of evaluating the risks and merits of an investment in the Units Interests and of protecting its own interests in connection with this investment.

Preexisting Relationship or Experience. By reason of its business or financial experience, or by reason of the business or financial experience of its general partner or its financial advisor who is unaffiliated with and who is not compensated, directly or indirectly, by the Company LLC or any Affiliate affiliate or selling agent of the CompanyLLC, such Member it is capable of evaluating the risks and merits of an investment in the Units Membership Interest and of protecting its own interests in connection with this investment.

Preexisting Relationship or Experience. By reason of his, her or its business or financial experience, or by reason of the business or financial experience of his, her or its financial advisor who is unaffiliated with and who is not compensated, directly or indirectly, by the Company or any Affiliate or selling agent of the Company, such Member he, she or it is capable of evaluating the risks and merits of an investment in the Units Interest and of protecting his, her or its own interests in connection with this investment.
