Common use of Preexisting Relationship or Experience Clause in Contracts

Preexisting Relationship or Experience. The Member has a preexisting personal or business relationship with the Company or its Members, or by reason of the Member's business or financial experience, or by reason of the business or financial experience of the Member's financial advisor who is unaffiliated with and who is not compensated, directly or indirectly, by the Company or any affiliate or selling agent of the Company, the Member is capable of evaluating the risks and merits of an investment in the Company and of protecting the Member's own interests in connection with this investment.
