Common use of Prescription Communications Clause in Contracts

Prescription Communications. (a) eRx takes no responsibility for: (1) any Prescription Communication; (2) the data or information represented by or contained in any Prescription Communication; (3) the underlying obligations or relationships between any Relevant Businesses represented by any Prescription Communication; or (4) any damages, losses or expenses suffered or incurred by the IT Vendor in connection with the failure or delay of any Prescription Communication occurring over or by means of the Gateway including the corruption of any Prescription Data. (b) A certificate signed by or on behalf of eRx will, for all purposes of this Agreement, be conclusive evidence of the number and nature of the Prescription Communications and Transmissions occurring over the Gateway and the number of Prescription Data Transmitted over the Gateway.
