Preserved Rights. This Agreement and General Release is not intended to, and shall not, in any way prohibit, limit or otherwise interfere with (a) the Executive’s protected rights under federal, state or local employment discrimination laws (including, without limitation, the ADEA and Title VII) to communicate or file a charge with, initiate, testify, assist, comply with a subpoena from, or participate in any manner in an investigation or proceeding conducted by, the Equal Employment Opportunity Commission (“EEOC”) or similar federal, state or local government body or agency charged with enforcing employment discrimination laws; provided, however, the Executive shall not be entitled to any relief or recovery (whether monetary or otherwise), and the Executive hereby waives any and all rights to relief or recovery, under, or by virtue of, any such filing of a charge with, or investigation, hearing or proceeding conducted by, the EEOC or any other similar federal, state or local government agency relating to any claim that has been released in this Agreement and General Release; or (b) the Executive’s protected right to test in any court, under the Older Workers Benefit Protection Act, or like statute or regulation, the validity of the waiver of rights under ADEA in this Agreement and General Release; or (c) the Executive’s protected right to disclose any facts necessary to receive unemployment insurance, Medicaid, or other public benefits to which he is entitled; or (d) the Executive’s right to enforce the terms of this Agreement and General Release and to exercise his rights relating to any other Excluded Claims.

(a) the The Executive’s protected rights under federal, state or local employment discrimination laws (includinglaw, without limitation, notice to the ADEA and Title VIICompany: (i) to communicate or file a charge with, initiatea government regulator, testify, assist, comply with a subpoena from, or (ii) participate in any manner in an investigation or proceeding conducted byby a government regulator, or (iii) receive an award paid by a government regulator for providing information; provided, however, if you bring a claim before the Equal Employment Opportunity Commission (“EEOC”) or similar federal, state or local government body or agency charged with enforcing employment discrimination laws; provided, however, the Executive you shall not be entitled to any relief or recovery (whether monetary or otherwise), and the Executive hereby waives any and all rights to relief or recovery, under, or by virtue of, any such filing of a charge with, or investigation, hearing or proceeding conducted by, the EEOC or any other similar federal, state or local government agency relating to any claim that has been released in this Agreement and General Release; orAgreement;
(b) the Executive’s protected right to test in any courttest, under the Older Workers Benefit Protection Act, or like statute or regulation, the validity of the waiver of rights under ADEA in this Agreement and General Release; or
(c) the Executive’s protected rights to discuss or disclose information about unlawful acts in the workplace, such as harassment or discrimination or any other conduct that you have reason to believe is unlawful; or
(d) Executive’s right to disclose any facts necessary to receive unemployment insurance, Medicaid, or other public benefits to which he is entitled; or
(de) the Executive’s right to enforce the terms of this Agreement and General Release and to exercise his rights relating to any other Excluded Unreleased Claims; or
(f) Executive’s right, if any, to engage in protected activity under the National Labor Relations Act.
