Prevailing Party Provision. In the event that a party to this Subcontract institutes a legal action of any kind against the other party, based on any failure or alleged failure to perform in accordance with this Subcontract, the prevailing party shall, in addition to any other relief to which it may be entitled under this Subcontract or in final judgment, be entitled to collect from the other party its costs, expenses and reasonable attorney's fees in pursuing the action.
