PREVAILING RIGHTS Clause Samples

The Prevailing Rights clause establishes that certain rights or benefits previously granted to parties, often through earlier agreements or established practices, will continue to apply even after a new agreement is made. In practice, this means that if employees or parties had more favorable terms under a prior contract or custom, those terms remain in effect unless the new agreement specifically changes them. This clause ensures continuity and protects parties from losing existing advantages simply because a new contract is signed, thereby preventing the unintentional erosion of established rights.
