Common use of Prevailing Party’s Fees Clause in Contracts

Prevailing Party’s Fees. If the parties hereto become parties to any litigation, commenced by or against one another involving the enforcement of any rights or remedies under this Agreement, or arising on account of a default of the other party in its performance of such party's obligations hereunder, the prevailing party in such litigation shall be entitled to reimbursement of all of its legal fees, costs, and expenses incurred in connection with such litigation, and interest accrued thereon from the date of judgment, at the maximum rate permitted by law.
