Common use of Priority; Insurance Claims Clause in Contracts

Priority; Insurance Claims. The Servicer will be responsible for retaining counsel on behalf of Owner to advise Servicer whether any proposed relief for the Mortgagor pursuant to Section 3.03 will adversely affect claims against any other Mortgagor or the priority of the lien securing the Mortgage Loan. The Servicer will be responsible for determining that such relief will not adversely affect any applicable Mortgage Insurance or other guaranty. The Servicer shall consider the effect of such relief on the priority of the lien, claims against other Mortgagors and the effect on Mortgage Insurance or other guarantees in acting hereunder.
