Priority of Agreement. 19. The Parties hereby agree that if at the time of registration of this Agreement there are any encumbrances on title to the Lands held by any party other than the Municipality, the Owner shall arrange for the discharge of such encumbrances from title. In the alternative, the Owner shall, prior to the registration of this Agreement, obtain a postponement and consent in favour of the Municipality for each encumbrance to this Agreement’s priority on title of the Lands and provide proof to the Municipality that the Postponement and Consent has been registered on title to the Lands.
