Mortgagees. The owners agree to obtain a postponement of any mortgages or other encumbrances which may affect the Lands.
Mortgagees. We will make payment for loss or damage to buildings payable jointly to you and to any mortgagees endorsed herein, as your respective interests may appear. The mortgagee has the right to receive loss payment even though:
a. You failed to comply with the terms and conditions of this coverage Section; or
b. Your mortgagee starts fore- closure or similar actions of the subject building. If we make loss payments to your mortgagee when you fail to comply with the terms and conditions of this coverage part, you must reimburse us to the extent we paid your mortgagee. Your mortgagee will still have the right to receive the balance of the mortgage debt from you. We also have the right to take over your mortgage after making loss payment to the mortgagee. If we do, you will pay the balance of your mortgage debt to us. If you fail to pay your premium, we may request it from your mortgagee. Your mortgagee must notify us of any change in ownership of a covered property known to the mortgagee. If we cancel this coverage part, we will give the mortgagee, endorsed herein, the same notice of cancellation we will give you.
Mortgagees i. The Party(ies) of the Third Part join herein to consent hereto and to bind their interest in the Lands and agree to be bound by the terms of this Agreement.
Mortgagees. 10.1 The obligations contained in this Deed will not be enforceable against any mortgagee or chargee from time to time of the whole or any part of the Site or Sites unless it takes possession of the Site or Sites (through the exercise of its powers under the relevant charge) in which case it will be bound by the obligations applicable to the Site or Sites or (as the case may be) part of the Site or Sites to which the relevant mortgage or charge applies
Mortgagees. Anything herein to the contrary notwithstanding, the Association shall not be responsible to any mortgagee or lienor of any Unit hereunder, and may assume the Unit is free of any such mortgages or liens, unless written notice of the existence of such mortgage or lien is received by the Association.

Mortgagees. If there is more than one Leasehold Mortgage, Landlord shall recognize the Leasehold Mortgagee whose Leasehold Mortgage is senior in lien as the Leasehold Mortgagee having priority as to the rights of a Leasehold Mortgagee under this Article 11.
Mortgagees. Landlord represents and warrants to Tenant that, as of the Effective Date, neither the Site nor the Building is encumbered by any mortgage.
Mortgagees. 19.1 Any legal charge entered into in respect of the Site or any part of the Site after this Agreement has been completed shall take effect subject to this Agreement PROVIDED THAT the mortgagee under such a legal charge shall not be liable for any breach of the obligations in this Agreement unless committed or continuing at a time when the mortgagee has taken and is in possession of all or any part of the Site.
19.2 The Mortgagee consents to the completion of this deed and declares that its interest in the Site shall be bound by the terms of this deed as if it had been executed and registered as a land charge prior to the creation of the Mortgagee's interest in the Site
Mortgagees. No mortgagee shall have any right to determine or participate in the determination as to whether or not any damaged property shall be reconstructed or repaired, and no mortgagee shall have any right to apply or have applied to the reduction of a mortgage debt any insurance proceeds, except for actual distributions thereof made to the Unit Owner and mortgagee pursuant to the provisions of this Declaration.
