Priority of Lien on Personalty. No chattel mortgage, xxxx of sale, security agreement, financing statement or other title retention agreement has or will be executed with respect to any materials, fixtures, machinery, equipment or other personal property of the Borrower given as security for the Loan, without the prior written consent of the City.
Priority of Lien on Personalty. No chattel mortgage, bill xx sale, security agreement, financing statement or other title retention agreement (except those executed in favor of Lender) has been or will be executed with respect to any personal property, chattel or fixture granted to Lender under the Loan Documents as security for the payment and performance of the Loan obligations.

No chattel mortgage, security agreement, financing statement or other title retention agreement (except those executed in favor of Lender) has been or will be executed with respect to any personal property, chattel or fixture used in connection with the operation or maintenance of the Premises.

Priority of Lien on Personalty. Except as set forth on Schedule 3.1(g) attached hereto, no security interest (except in favor of Lender) exists with respect to any Assets of Borrower.

That no bxxx of sale, security agreement, financing statement or other title retention agreement (except those executed in favor of Lender) has or will be executed with respect to any personal property, equipment or fixtures used in conjunction with the construction, operation or maintenance of the Improvements located on the Property owned by Borrower other than Improvements for a CDD.

That no bill xx sale, security agreement, financing statement or other title retention agreement (except those executed in favor of Lender) has or will be executed with respect to any personal property, equipment or fixtures used in conjunction with the construction, operation or maintenance of the Improvements.
Priority of Lien on Personalty. Except as set forth on Schedule 4(f) attached hereto, no chattel mortgage, xxxx of sale, security agreement, financing statement or other title retention agreement (except those executed in favor of Lender) has been or will be executed with respect to any of the Collateral unless (i) terminated or otherwise no longer in force and effect or (ii) otherwise permitted in accordance with the Security Agreement, the Mortgage and the other Loan Agreements.
Priority of Lien on Personalty. No security interest (except in favor of Lender) exists with respect to any personal property, chattel or fixture used in, or in connection with, the construction, operation or maintenance of the Improvements.
