Private Cause of Action. Whether § 83.561 creates a private cause of action by the tenant for possession or damages is a recurring issue. It may be argued that § 83.48, Fla. Stat., contemplates a cause of action for violations of the Landlord Tenant Act, unless expressly prohibited. However, unlike other alleged violations of a landlord’s duties, the issuance of a writ of possession only occurs by virtue of judicial action. The prior PTFA was uniformly construed not to create a private cause of action. See, Construction and Application of Protecting Tenants at Foreclosure Act of 2009, 65 A.L.R. Fed. 2d 217. If so construed § 83.561 would not create a private cause of action for damages against the mortgage foreclosure purchaser, except for a violation of the landlord’s duties, undertaken by the purchaser pursuant to § 83.67. However, if a party to the mortgage foreclosure lawsuit, or permitted to intervene, a tenant may object to the issuance of a writ of possession based upon non-compliance with § 83.561.

  • Contract Termination Provision This contract may be terminated at any time by City for any cause without penalty or liability except as may otherwise be specified herein. Upon receipt of written notice by City, Engineer shall immediately discontinue all services and Engineer shall immediately terminate placing orders or entering into contracts for supplies, assistance, facilities or materials in connection with this contract and shall proceed to cancel promptly all existing contracts insofar as they are related to this contract. As soon as practicable after receipt of notice of termination, Engineer shall submit a statement showing in detail the services performed but not paid for under this contract to the date of termination. City shall then pay Engineer promptly the accrued and unpaid services to the date of termination, to the extent the services are approved by City. This contract may be terminated by Engineer with mutual consent of City at any time for any cause without penalty or liability except as may otherwise be specified herein. Engineer shall submit written notice to terminate contract and shall submit to City all plans and documents relative to the design of Project. City shall then ascertain cost to complete the balance of the work under this contract. If the cost to complete the balance of the work is greater than the unpaid contract amount, City shall retain all unpaid balances and, in addition, Engineer shall pay directly to City the difference in the unpaid balance and the cost to complete the work. In no case shall City pay Engineer any additional monies other than those previously paid under the contract.

  • No Employment Relationship Whether or not any Options are to be granted under this Plan shall be exclusively within the discretion of the Plan Administrator, and nothing contained in this Plan shall be construed as giving any person any right to participate under this Plan.   • Employment Relationship Employment with the Company is for no specific period of time. Your employment with the Company will be “at will,” meaning that either you or the Company may terminate your employment at any time and for any reason, with or without cause. Any such termination shall be without liability of any party to any other party except that the provisions of Section 5(a)(viii) and Section 7 hereof shall at all times be effective and shall survive such termination.

  • Contract Termination debarment. A breach of the contract clauses in 29 CFR 5.5 may be grounds for termination of the contract, and for debarment as a contractor and a subcontractor as provided in 29 CFR 5.12.
