Procedure for binding determination. (a) In making a determination under clause 4.1, the Commonwealth must take into account all relevant documentation and submissions made by the Participant in relation to the determination. (b) After making a determination under clause 4.1, the Commonwealth must provide to the Participant written reasons for the determination.
