Common use of Procedure for Bringing Disputes before the CPO Clause in Contracts

Procedure for Bringing Disputes before the CPO. Only after the Commissioner has rendered a final decision denying the Contractor’s claim may a dispute be brought before the CPO. If the Contractor and using Department are unable to resolve the dispute, prior to seeking any judicial action, the Contractor must and the using Department may submit the dispute the CPO for an administrative decision based upon the written submissions of the parties. The party submitting the dispute to the CPO must include documentation demonstrating its good faith efforts to resolve the dispute and either the other party’s failure to exercise good faith efforts or both parties’ inability to resolve the dispute despite good faith efforts. The decision of the CPO is final and binding. The sole and exclusive remedy to challenge the decision of the CPO is judicial review by means of a common law writ of certiorari.
