Common use of Process of Serving Notice Clause in Contracts

Process of Serving Notice. Except as otherwise set forth herein or in any other Loan Document, all notices under this Loan Agreement and any other Loan Document shall be: in writing and shall be: delivered, in person; mailed, postage prepaid, either by registered or certified delivery, return receipt requested; sent by overnight courier; or sent by electronic mail with originals to follow by overnight courier; addressed to the intended recipient at Borrower’s Notice Address and Lender’s Notice Address, as applicable; and deemed given on the earlier to occur of: the date when the notice is received by the addressee; or if the recipient refuses or rejects delivery, the date on which the notice is so refused or rejected, as conclusively established by the records of the United States Postal Service or such express courier service.
