Common use of Product Availability Clause in Contracts

Product Availability. The Lead State should not allow any cancellation of products without an equal and acceptable replacement approved by the Contracting Officer. Offerors should communicate discontinuation of any products to the Contracting Officer in writing within five (5) business days. Offerors shall work with the Contracting Officer to identify and implement alternative options that will maintain or reduce costs associated with the replacements. Offerors should offer suggested replacements of discontinued products at least 30 business days prior to substitution, including replacement product number, description, specifications, and final price.
